Resolution to Approve a Construction Contract with Ajax Paving Industries, Inc. for the Research Park Drive Resurfacing Project. (RFP No. 23-10, $3,372,459.43)

Memorandum

Attached for your review and approval, please find a resolution to approve a construction contract with Ajax Paving Industries, Inc. in the amount of $3,372,459.43 for the Research Park Drive Resurfacing Project (RFP 23-10).

 

In August of 2022 the City applied for and later received a Transportation Economic Development Fund Category A (TEDF-A) grant from the Michigan Department of Transportation (MDOT) to rehabilitate/resurface a portion of Research Park Drive in conjunction with a proposed technology/research development project (Sartorius North America - 3874 Research Park Drive) within the project limits. Rather than resurfacing only the part of Research Park Drive influenced by the proposed development (and thus eligible for the grant), the City worked with the MDOT to create a project that addresses the entirety of the roadway and the poor pavement condition that currently exists. The resurfacing work will involve the following elements:

 

                     Full depth removal and replacement of the asphalt pavement.

                     Reconstruction of the roadway base and subbase in select areas together with reconditioning of the remainder of the base that will remain in place.

                     Removal and replacement of segments of concrete curb and driveway openings and portions of driveway approach aprons.

                     The addition of bike lanes in both directions along the entirety of the roadway.

 

Engineering staff supervised the creation of plans and contract documents and solicited proposals for construction of the project through the City’s Procurement Unit. On March 21, 2023, five (5) proposals were received for this work. A selection committee comprised of Engineering staff reviewed the proposals and determined the proposal from Ajax Paving Industries, Inc. provided the best value based on the following criteria provided in ORD-21-41, adopted by Council on January 3, 2022:

 

                     Qualifications, Experience & Accountability (20%)

                     Workplace Safety (20%)

                     Workforce Development (20%)

                     Social Equity & Sustainability (20%)

                     Schedule of Pricing/Cost (20%)

 

Accordingly, staff recommends awarding the contract for this project to Ajax Paving Industries, Inc. Attached is a summary of the proposal scoring results. Ajax Paving Industries, Inc. complies with the City’s Non-Discrimination and Living Wage ordinances.

 

Construction of the project is scheduled to begin in early June and be complete by late August 2023. The project work will be done in two stages with construction occurring on one side of the roadway and traffic being maintained in one direction on the other side.

 

Budget/Fiscal Impact:  This project (TR-SC-22-35) is included in the FY2024-2029 Capital Improvements Plan. The estimated total cost of the project is $4,290,000.00. The project funding sources are listed below with the majority coming from the TEDF-A grant received from the MDOT Office of Economic Development and proceeds of Michigan Transportation Fund (MTF) Road Repair and Reconstruction Bonds.

The project includes the installation of new bike lanes that will increase pavement marking maintenance requirements. This estimated annual cost ($6,100.00) will be absorbed by the appropriate operating unit and its budget.

Whereas, Based upon the condition assessment and ratings of the existing pavement on Research Park Drive there is a demonstrated need to resurface the roadway and make other related infrastructure improvements;

 

Whereas, Funding for the project is available from an MDOT Transportation Economic Development Fund Category A Grant, the Major Street Michigan Transportation Road Bond, and various City utility funds;

 

Whereas, Proposals were received by the City’s Procurement Office on Tuesday, March 21, 2023, and Ajax Paving Industries, Inc. received the highest score among the proposals reviewed by the selection committee;

 

Whereas, It is appropriate now to enter into a contract with said company for said construction project;

 

Whereas, The contract sets forth, among other things, the services to be performed by said company, and the payments to be made by the City therefore, all of which are agreeable to the City; and

 

Whereas, Ajax Paving Industries, Inc. complies with the City of Ann Arbor Non-Discrimination and Living Wage Ordinances;

 

RESOLVED, That City Council approve a construction contract with Ajax Paving Industries, Inc. in the amount of $3,372,459.43 for the Research Park Drive Resurfacing Project (RFP No. 23-10);

 

RESOLVED; That the funding be available without regard to fiscal year until project completion;

 

RESOLVED, That a contingency amount of $350,000.00 be established within the project budget and that the City Administrator be authorized to approve additional change orders to the construction contract with Ajax Paving Industries, Inc. not to exceed $350,000.00 in order to satisfactorily complete this project;

 

RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said contract after approval as to form by the City Attorney and approval as to substance by the City Administrator; and

 

RESOLVED, That the City Administrator be authorized to take necessary administrative actions to implement this resolution, including issuing temporary and permanent Traffic Control Orders and night work authorizations as required for the construction of the project.
