Resolution to Approve Amendment No. 5 to the Professional Services Agreement with DLZ Michigan, Inc. for Engineering Design Services for the E. Medical Center Drive Bridge Rehabilitation and Widening Project ($ 615,216.72 increase, total contract $ 1,685,347.40) (RFP 21-20)

Memorandum

This memorandum and resolution requests approval of Amendment No. 5 to the professional services agreement for professional engineering services with DLZ Michigan, Inc. (DLZ).  Council approved a professional services agreement for $1,011,319.29 with DLZ in October 2021 as part of Resolution No. R-21-395. Amendments No. 1 through 4 were subsequently approved administratively, as they were within the Council-approved contingency.

 

On February 21, City Council approved Resolution R-23-059 to commence a collaborative planning process between the University of Michigan and the City of Ann Arbor for the rehabilitation, widening, and non-motorized transportation enhancement of the East Medical Center Drive Bridge. To carry out the redesign work necessary to comply with this Resolution, the professional services agreement with DLZ must be extended to account for the additional effort.

 

Engineering staff has negotiated the scope of work and associated fee for this project and that is reflected in the attached Amendment No. 5. DLZ complies with the requirements of the City’s Non-Discrimination and Living Wage ordinances. 

 

Construction of the project is currently anticipated to begin in the spring of 2024 and to conclude in 2025.

 

Budget/Fiscal Impact:  Based on the agreement negotiated between the City Administrator’s office and the University of Michigan, the additional cost of the redesign effort described in Amendment No. 5 will be split between the University of Michigan and the City (75% UM and 25% City).

Body

Whereas, Additional professional engineering services are necessary to redesign the E. Medical Center Drive Bridge project in accordance with Resolution R-23-059;

 

Whereas, The professional engineering firm of DLZ Michigan, Inc., of Lansing, Michigan has submitted to the City a scope of work for the necessary services, setting forth the services to be performed by said firm, and the payments to be made by the City therefor, all of which are agreeable to the City;

 

Whereas, The City of Ann Arbor will bear 25% and the University of Michigan 75% of the costs for the redesign work; and

 

Whereas, DLZ Michigan, Inc. is in compliance with the requirements of the City’s Non-Discrimination and Living Wage ordinances;

 

RESOLVED, That City Council approve Amendment No.5 to the Professional Services Agreement with DLZ of Michigan Inc. in the amount of $615,216.72 for Engineering Design Services for the E. Medical Center Drive Bridge Rehabilitation and Widening Project;

 

RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said agreement, after approval as to form by the City Attorney and approval as to substance by the City Administrator;

                     

RESOLVED, That a contingency amount be established and the City Administrator be authorized to approve additional amendments to the professional services agreement not to exceed $70,000 in order to satisfactorily complete the project; and

 

RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
