Memorandum

This memorandum and resolution requests approval to award a construction contract to Weiss Construction Co. LLC for the Barton Pump Station Valve Improvement Project ($4,656,400.00) (ITB No. 4703).

 

The City submitted a Project Plan to the Michigan Department of Environment, Great Lakes, and Energy (EGLE) for a Drinking Water State Revolving Fund (DWSRF) loan to finance the Barton Pump Station Valve Improvement Project. The Project Plan was reviewed and scored by EGLE, ranking within the fundable range of the final Project Priority List (PPL) for federal and state-match funding. The Barton Pump Station Valve Improvements Project is eligible to receive DWSRF funding and is eligible for a Drinking Water Infrastructure (DWI) Grant estimated to be $1,380,000.00.

 

Barton Pump Station supplies 80% of the City’s raw source water from the Huron River to the Water Treatment Plant. Many of the station valves and piping remain in service from the original date of construction over 70 years ago.  The scope for this project will include replacement of aging and inoperable valves and the associated piping at Barton Pump Station and installing new air release valves on the existing 42-inch and 24-inch raw water transmission mains.  The proposed improvements are necessary to assure operational control and system reliability for the City’s critical raw source water supply infrastructure. This project is programmed in the City’s Capital Improvements Plan (UT-WS-20-04).

 

The Invitation to Bid No. 4703 was advertised on the City’s website and on MITN.  On January 20, 2022, the City received one (1) bid from Weiss Construction Co. LLC in the amount of $4,656,400.00. Staff has determined that Weiss’ bid is responsible, and it is in line with the construction cost estimate. 

 

It is recommended that their bid be accepted for a total contract value of $4,656,400.00, and that Weiss Construction Co. LLC be awarded the construction contract for the Barton Pump Station Valve Improvement project.

 

Budget/Fiscal Impact: Total project cost is estimated at $6,180,000.00 and is included in the Water Supply System Capital Improvement Budget. The project is intended to be reimbursed through a DWSRF low interest loan from EGLE including an estimated $1,380,000.00 Grant in the form of loan forgiveness. In the case that the application for the DWSRF low interest is not successful, other funding is available in the Water Supply System Capital Budget.

 

Weiss Construction Co. LLC submitted all required Non-Discrimination, Prevailing Wage, Living Wage, and Conflict of Interest Disclosure forms and complies with the requirements of the City’s Non-Discrimination and Living Wage ordinances.

Whereas, The Barton Pump Station is critical infrastructure and supplies 80% of the City’s raw source water from the Huron River to the City’s Water Treatment Plant;

 

Whereas, The Barton Pump Station Valve Improvement Project will ensure that a reliable supply of raw source water is delivered to the City’s Water Treatment Plant;

 

Whereas, The City recognizes the benefits of improvements to its critical water system infrastructure;

 

Whereas, The Barton Pump Station Valve Improvements Project Plan formally adopted on June 21, 2021 (R-21-221) will be funded through the state of Michigan’s Drinking Water State Revolving Loan Fund (DWSRF) program;

 

Whereas, Competitive bids were received by Procurement on January 20, 2022 (ITB No. 4703) and the bid received from Weiss Construction Co. LLC has been evaluated as a responsible bid in the amount of $4,656,400.00;

 

Whereas, The Barton Pump Station Valve Improvement Project is included as a project in the Capital Improvement Plan;

 

Whereas, Funding is to be advanced from the Water Supply Systems Operating Fund balance to be repaid pending the sale of water revenue bonds through the DWSRF Loan Program; and

 

Whereas, Weiss Construction Co. LLC has submitted all required Non-Discrimination, Prevailing Wage, Living Wage, and Conflict of Interest Disclosure forms and complies with the requirements of the City’s Non-Discrimination and Living Wage ordinances;

 

RESOLVED, That City Council approve a construction contract with Weiss Construction Co., LLC in the amount of $4,656,400.00 for the Barton Pump Station Valve Improvement Project;

 

RESOLVED, That a contingency in the amount of $470,000.00 be established within the project budget and that the City Administrator be authorized to approve additional change orders to the construction contract with Weiss Construction Co. LLC not to exceed that amount, in order to satisfactorily complete this project;

 

RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said agreement after approval as to substance by the City Administrator and approval as to form by the City Attorney;

 

RESOLVED, That the City makes the following declaration for the purpose of complying with the reimbursement rules of Treas. Reg. 1.150-2 pursuant to the Internal Revenue Code of 1986, as amended, that the City reasonably expects to reimburse itself for expenditures for the costs of the Barton Pump Station Valve Improvement Project with proceeds of Bonds; and

 

RESOLVED, That the City Administrator be authorized to take all necessary actions to implement this resolution including execution of any authorized renewals and any changes or amendments that do not exceed the contingency amount.
