Resolution to Award a Contract to Margolis Companies, Inc. for the As-Needed Purchase, Delivery and Planting of Trees on City Property and Along Street Rights-of-Way for the Elizabeth Dean Fund Tree Planting Projects (Not to Exceed $55,000.00; Bid No. ITB-4692)

Attached for your review and action is a resolution to authorize the awarding of a contract to Margolis Companies, Inc. in the amount of $55,000.00 for the planting of trees in city parks and along City street rights-of-way.
After the original ITB-4688 received no bids by its August 18, 2021 due date, ITB-4692 was reissued on BidNet for tree planting, which included the purchase, delivery, and planting of approximately 130 trees in parks and along City street rights-of-way, and a one-year guarantee. One bid was received and opened on September 17, 2021.
The Elizabeth Dean Fund Committee identified and approved tree planting projects to plant approximately 130 trees in parks and along city street rights-of-way. These projects all meet the spirit and intent of Elizabeth Dean to be used “to repair, maintain, or replace trees on city property in the City of Ann Arbor, perpetually.” and will be spent in accordance with the purpose of the Elizabeth Dean Trust Fund. The trees will be planted along the Jackson Road median at Westover Avenue, Riverside Park along the river sidewalk, and other various city-owned properties throughout the City of Ann Arbor.
Sustainability Framework: The work completed through this contract will help to achieve tree canopy targets identified in the Urban and Community Forest Management Plan, adopted by City Council in June 2014 (R-14-0696). In addition, it will help fund and further various aspects of the City’s Sustainability Framework.
Budget/Fiscal Impact: The total maximum cost of the tree planting project is $55,000.00. Expenses will not exceed what is available in the approved FY22 Elizabeth R. Dean Trust Fund Budget and funds will be available in subsequent budgets if approved by Council.
The resolution includes a request for a 5% contingency in the amount of $2,750.00 to cover potential change orders to be approved by the City Administrator.

Whereas, Ann Arbor’s urban and community forest is a defining and valued characteristic of the city that residents call “Tree Town,” making it a desirable place to live, work and play;
Whereas, Street trees provide many environmental social and economic benefits to property owners throughout the city, including, controlling and decreasing the quantity and rate of stormwater runoff and improving the quality of runoff that reaches local lakes and streams;
Whereas, Elizabeth R. Dean willed nearly $2,000,000.00 for planting and maintaining city’s trees;
Whereas, One bid was received by the Procurement Unit on September 17, 2021, and Margolis Companies, Inc. of Ypsilanti, Michigan is a responsible bidder at $55,000.00;
Whereas, The contract provides for an extension of two (2) one-year terms, subject to the same terms, conditions and pricing of the original contract, if agreeable by the City and Contractor;
Whereas, Margolis Companies, Inc. complies with the City’s non-discrimination and Living Wage Ordinances; and
Whereas, Funds are programmed in the approved FY22 Elizabeth R. Dean Trust Fund Budget;
RESOLVED, That a contract not to exceed $55,000.00 be awarded to Margolis Companies, Inc. for the purchase, delivery and planting of trees along City street rights-of-way (Bid No. ITB-4692);
RESOLVED, That a contract contingency in the amount of $2,750.00 (5%) be established and the City Administrator be authorized to approve change orders to the contract with Margolis Companies, Inc., in order to satisfactorily complete this project;
RESOLVED, That the City Administrator be authorized to extend the contract for two (2) one-year terms, provided both parties agree to extension subject to the same terms, conditions and pricing of the original contract and availability of funding;
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said contract after approval as to form by the City Attorney and approval as to substance by the City Administrator; and
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
