Resolution to Approve the Second Amendment to the Southtown Development Agreement - 1601 S. State St.
Memorandum
Approval of this resolution will amend the Southtown Development Agreement, originally prepared for a site plan approved on September 5, 2023, to align with a revised site plan approved on April 7, 2026. Changes to the Development Agreement include deleting a paragraph regarding providing independent standards compliance documentation, because that provision was tied to use of premium floor area which is no longer part of the Unified Development Code and updating the park contribution calculation.
The Southtown Site Plan approved April 7, 2026 allows for construction of an 8-story residential building providing 289 apartments on a 1.7-acre site. The building has a one-story base with a 41-space parking garage and a C-shaped tower open to the west. A self-contained, on-site energy system is located on the east side of the site to generate all power needs for the building as required by the zoning conditions in the adopted and incorporated Conditional Zoning Statement of Conditions. It supersedes a previously approved site plan of about the same building mass and height but with a different tower configuration and roughly 60 fewer apartments.
The Southtown project was originally approved on September 5, 2023, including a conditional rezoning, an alley vacation, and site plan and development agreement approval. The zoning conditions were amended in 2024 along with a first amendment to the development agreement. A revised site plan was approved by the Planning Commission on April 7, 2026.
