Resolution to Approve the Arbor South Development Agreement - 2845 South State Street (SP24-0011) (CPC Recommendation: Approval - 5 yes, 0 no)

Memorandum

This resolution will approve a Development Agreement between the City of Ann Arbor and Eisenhower State Land Development Company, LLC, the developer of the Arbor South project to construct 14 new buildings in a downtown-style development around two existing buildings at 777 and 789 E Eisenhower, including a hotel, apartment buildings (most with ground-floor retail uses), restaurant and retail buildings, and parking structures. The 23.5-acre site is zoned TC1 (Transit Corridor).

 

The City Planning Commission at its meeting of June 17, 2025 approved the Arbor South Site Plan with conditions and subject to entering into and satisfying all terms of a development agreement. Conditions of approval included outstanding comments from the Engineering, Solid Waste, Planning, and Transportation Engineering being resolved to the respective managers’ satisfaction and documented, which were completed by September 16, 2025.

 

A Development Agreement requires approval by City Council. The attached Arbor South Development Agreement specifies requirements associated with approved 2845 S State St Site Plan, including both standard construction and development procedures and specialized terms directly resulting from the development and/or benefitting the project.

Whereas, The 2845 S State St Site Plan was conditionally approved by the City Planning Commission on June 17, 2025 in order to develop apartment buildings, most with ground-floor retail uses, a hotel, restaurants and retail buildings, and parking structures in a downtown-style around two existing buildings at 777 and 789 E Eisenhower;

 

Whereas, The approval conditions were satisfactorily resolved and documented; and,

 

Whereas, A development agreement has been prepared to address construction approval procedures, granting easements, contributions to the park system, and other developer commitments;

 

RESOLVED, That City Council approves the development agreement, substantially in the form of that attached;

 

RESOLVED, That the Mayor and City Clerk are authorized and directed to sign the development agreement after approval by the City Administrator and City Attorney; and

 

RESOLVED, That the City Administrator is authorized to take all appropriate actions to implement this resolution and the development agreement, including exercising all determinations and authority delegated to the City under the development agreement and execution and management of all other agreements contemplated under the development agreement after approval by the City Attorney.
