Attached for you review and approval is a resolution to ratify the purchase and construction of 410 linear feet of eight-inch ductile iron water main from Fonson, Inc.
 
As part of the site plan approval for the Chalmers Place project, the developer agreed to reconstruct Chalmers Road from Washtenaw Avenue northerly approximately 280 feet.  During the reconstruction, the developer's general contractor, Shafer Construction, discovered several water main leaks affecting the quality of the road base.  Field Operations staff investigated and determined that the most cost effective course of action was to replace the entire section of water main rather than attempt several repairs and risk future leaking under the new asphalt.
 
Approximately 410 linear feet of eight-inch water main required replacement in Chalmers Road from Washtenaw Avenue to the north.  In order to provide timely completion of the water main construction, thereby minimizing public disruption with the road reconstruction which had already commenced, it was determined that utlizing the onsite contractor was the best course of action.  At the City's request Fonson, Inc., provided Public Services with an estimate for the water main work.  The pricing was determined to be competive and, by comparison, less than the pricing provided by Fonson, Inc. , when it constructed the Glen Leven Water Main project in 2005 under contract through Project Management.  The work water main work in Chalmes Road was performed in October and completed in November.
 
Final construction invoicing for the project totaled $57,067.00, which included the water main installation, density testing of backfill operations and intersection reconstruction.  The intersection reconstruction was not part of the developer's responsbility for reconstruction but was required due to the water main construction.  Reconstruction of the intersection included ensuring the corner ramps and street crosswalks were compliant with the Americans with Disabilities Act.  Sole sourcing this work saved significant time and expense because Fonson, Inc., was already familiar with the project and was already mobilized on site with traffic control in place.
 
Using estimates from the Glen Levin water main project noted above which was constructed by the city in 2005, the construction estimate for a project of this scope was nearly $90,000, resulting in a cost savings of around $30,000.

Whereas, A private developer, responsible for reconstructing a portion of Chalmers Drive, discovered several water main leaks affecting the quality of the road base;
 
Whereas, Field Operations staff determined the most cost effective course of action to address the integrity of the water main and mimimize damage to the new pavement was to replace approximately 410 linear feet of water main;
 
Whereas, the on-site contractor, Fonson, Inc., supplied staff with a bid that offerred competitive pricing that was less than comparable jobs recently constructed by the city;
 
Whereas, in order to minimize continued public disruption and to permit completion of Chalmers Drive reconstruction prior to the end of the 2007 construction season, there was not opportunity to go through the standard bid process;
 
Whereas, funds for the project cost was available in the Field Operations, Water Fund Operating Budget;
 
Whereas, Fonson, Inc. received Human Rights approval on October 16, 2007, and complies with the living wage ordinance; and
 
Whereas, The sole-source purchase and installation of 410 linear feet of eight-inch ductile iron water main from Fonson, Inc. was the most cost effective solution to complete the water main construction and allow reopening of Chalmers Road to the motoring public with the least amount of delay;
RESOLVED, That the contract and purchase order to Fonson, Inc in the amount of $57,067 for the sole-source purchase and installation of 410 linear feet of eight-inch ductile iron water main be approved, subject to approval as to substance by the City Administrator and subject to approval as to form by the City Attorney; and
 
RESOLVED, That the City Administrator is authorized to take necessary administrative actions to implement this resolution.
