Memorandum

Request to award a contract to DeMaria Building Company to construct the Wastewater Treatment Plant (WWTP) Influent Sewer Odor Control Project at the City's WWTP.

 

The work to be performed under this contract includes construction of an odor control facility at an influent manhole just outside the plant access road to address odor concerns that were identified in the odor control study conducted by Greeley and Hansen, LLC and identified by the public during the public engagement process.  The work is part of the WWTP's Sewage Residuals Management Plan (SRMP).  The SRMP is a comprehensive 25-year planning document that provides the basis and schedule for rehabilitation and replacement of major solids handling equipment and systems at the WWTP.

 

WWTP staff solicited public bids for constructing the WWTP Influent Sewer Odor Control Project as specified in Bid No. 3901.  Six bids were received on November 28, 2007 as follows:

 

DeMaria Building Company                      $56,729.00

Spence Brothers                                                               $59,700.00

Adams Building Contractors                     $62,941.00

Anglin Civil Construction Co.                      $69,399.17

O'Laughlin Construction Co.                     $70,815.00

A. Z. Shmina, Inc.                                                               $98,000.00

 

WWTP staff reviewed the bids and found DeMaria Building Company to be the lowest responsible bidder and recommends award of the construction contract.  DeMaria Building Company received Human Rights approval on December 17, 2007 and complies with the City's living wage requirements.

 

You are requested to award this construction contract to DeMaria Building Company in the amount of $56,729.00.  A contingency of $6,000.00 is requested to manage unforeseen conditions associated with underground construction.  In addition, you are requested to authorize the City Administrator to approve change orders to the contract.

 

The total project budget of approximately $42,600,000.00 is included in the approved FY06-12 CIP.  Council approved a portion of the total project budget during the FY 08 budget process where funding for this contract is still available.  Funds to finance this project are available in the proceeds of the Sewer Revenue Bonds Series XIX, sold in the spring of 2004.

Whereas, The work to be performed is part of the WWTP's Sewage Residuals Management Plan;

 

Whereas, The work is included in the approved FY 06/12 Capital Improvements Plans;

 

Whereas, Funding is available in the Sewage Residuals Management project budget approved by Council during the FY08 capital budget process; and

 

Whereas, DeMaria Building Company received Human Rights approval on December 17, 2007 and complies with the City's living wage requirements;

 

RESOLVED, That Council award a contract to DeMaria Building Company  in the amount of $56,729.00 to construct the project;

 

RESOLVED, That Council approve a contingency of $6,000.00 to manage unforeseen conditions associated with underground construction;

 

RESOLVED, That the City make the following declaration for the purpose of complying with the reimbursement rules of Treasury Regulations 1.150-2 pursuant to the Internal Revenue Code of 1986, as amended, the City reasonably expects to reimburse itself for expenditures for the cost of the project with proceeds of Bonds;

 

RESOLVED, That Council authorize the City Administrator to approve amendments to the contract within the amount of the contingency; and

 

RESOLVED, That the Mayor and City Clerk be authorized to execute the contract after approval as to substance by the City Administrator and approval as to form by the City Attorney.
