Memorandum
Your approval is requested to amend a Professional Service Agreement with Hubbell, Roth & Clark, Inc. (HRC) in the amount of $9,624.00 for professional engineering services in construction support for the Sewage Lift Pumps Repair Project - Phase 2 at the City's Wastewater Treatment Plant (WWTP).
 
The WWTP utilizes five screw pumps to lift sewage into the plant for treatment. During 2002, repairs were completed on three of those screw pumps. Similar repairs to the other two screw pumps and complete refurbishment of the five motors and greasing systems were deferred to the second phase of the project. On June 5, 2005, Council resolved to approve a contract with Hubbell, Roth & Clark, Inc. (HRC) to provide professional engineering services to prepare design documents, review bids, and provide construction support services for the completion of the Sewage Lift Pumps Repair Project - Phase 2.  O'Laughlin Construction Company won the construction bid and received a notice to proceed in November 2006.
 
While providing construction support on the project, at City staff's request, HRC assisted in remedying unanticipated electrical wiring and timer issues and worked with the general contractor to correct problems caused by the equipment supplier and the supplier's electrical controls contractor. These efforts exceeded the scope of services specified in the agreement with the City resulting in an additional cost to HRC of $15,929.00. City staff found that $6,305.00 of the additional cost was due to the general contractor's deficiencies. This amendment is for the remaining amount of $9,624.00, which represents the reasonable expense to HRC for providing City requested services not included in original scope.
 
The project expenditure to date is $676,555.00. The original budget of $727,914.00 for the Sewage Lift Pumps Repair Project - Phase 2 included $94,914.00 for HRC engineering support. However, a contingency for engineering support was inadvertently omitted from the Council resolution that approved this project. Consequently, you are requested to approve an amendment to the contract with HRC in the of amount of $9,624.00. This will be the final payment to HRC for services rendered on this project.
 
HRC received Human Rights approval on January 8, 2009 and complies with the City's living wage requirements.
 
The project was funded by the proceeds of Sewer Revenue Bond Series XIX.  The funds were made available until expended without regard to fiscal year.

Whereas, A contingency fee amount was inadvertently omitted from the original agreement between the City and Hubbell, Roth &Clark, Inc.;
 
Whereas, City staff reviewed the final reimbursement request and found it to be reasonable;
 
Whereas, Hubbell, Roth &Clark, Inc. received Human Rights approval on January 8, 2009 and complies with the City's living wage requirements; and
 
Whereas, Funds are available in the proceeds of Sewer Revenue Bond XIX;
 
RESOLVED, That Council approve an amendment to the contract with HRC in the amount of $9,624.00; and
 
RESOLVED, The City Administrator be authorized to take all necessary actions to
implement this resolution.
