Resolution to Recommend Approval of Issuance of One New Class C Liquor License
Memorandum
On December 18, 2006, the City Clerk's Office was notified by the Michigan Liquor Control Commission that one (1) on-premise Class C license was available for issuance in the City of Ann Arbor due to the cancellation of a 2005 license issued to "To Dine For Restaurants, Ltd." at 326 W. Liberty. The total quota for on-premise consumption for the City of Ann Arbor, based on population, is 76 licenses with 75 licenses currently issued.
 
City Council established the Ad-Hoc Liquor License Committee on February 20, 2007 to address the issuance of the new quota license. Councilmembers Robert Johnson, Ron Suarez and Stephen Rapundalo were assigned to the committee. Councilmember Mike Anglin replaced Councilmember Johnson following the November 2007 election. The committee met over the summer and fall of 2007 and established guidelines for the application process, reviewed and established fees and developed a new application. A deadline of August 31, 2007 was set for the receipt of applications, with notice of the availability of the license and the application deadline published in the Ann Arbor News and the Detroit News. In total, 10 applications were accepted as timely and reviewed by the Liquor License Committee.
 
Three applications were forwarded to City staff for review: City of Ann Arbor Leslie Golf Course, Everyday Cook, and Sweet Waters Café. Following staff review, the committee met on Friday, December 21, 2007 and voted 2-1 to recommend to the City Council that the application of Everyday Cook be recommended for issuance to the State of Michigan Liquor Control Commission.
 
It is further recommended that a separate letter be forwarded to the State of Michigan Liquor Control Commission requesting that the Commission's approval be subject to receipt of final inspection and approval of the Premises for building, fire, and zoning code compliance.

Whereas, The City of Ann Arbor was notified by the State of Michigan Liquor Control Commission that the City has one available on-premise Class C liquor license available for award under the State's quota system;
 
Whereas, The decision to recommend issuance of a new quota liquor license is the prerogative of the local governmental unit;
 
Whereas, The City Council has established an Ad-Hoc Liquor Committee to review applications for the available Class C License; and
 
Whereas, The Ad-Hoc Liquor License Committee has published notice of the availability of the license, mailed out applications to all interested parties on the City Clerk's waiting list and reviewed all information submitted by applicants;
 
RESOLVED, That the City Council recommend that the Michigan Liquor Control Commission consider the request from Leslie Park Golf Course, 2120 Traver Road, Ann Arbor, MI 48105, for Approval "Above All Others" and that the application be recommended for issuance of a new Class C license;
 
RESOLVED, That a separate request be forwarded to the Michigan Liquor Control Commission that, should it award the license to Leslie Park Golf Course, that its issuance be subject to final code inspections and approval by the Ann Arbor Fire Department and Planning and Development Services;
 
RESOLVED, That the City Clerk forward a copy of this resolution to Leslie Park Golf Course and the Michigan Liquor Control Commission; and
 
RESOLVED, That the City Clerk send written notification to all applicants notifying them of the Ann Arbor City Council decision regarding the issuance of the new license.
