Memorandum
We request your approval of the attached resolution to amend the Professional Services Agreement (PSA) with Environmental Consulting & Technology, Inc. for engineering design services.
 
The purpose of this project is to stabilize the bank of Millers Creek at several locations along the stretch between Hubbard Street and Glazier Way.  Currently, severe bank erosion is occurring during peak flows in the creek and is threatening the City's infrastructure, including the non-motorized pathway running along Huron Parkway and an exposed sanitary sewer line.  The project designers have proposed changes to reduce bank erosion at these locations and preserve the municipal infrastructure.  Construction is currently planned for the Fall of 2008.
 
The Project Management Services Unit issued a Request for Proposal (RFP #648) in November of 2006 for a professional engineering firm to analyze and design the necessary bank stabilization measures in Millers Creek.  In response to our request, we received twelve proposals.  A review team composed of City staff from various Units evaluated the proposals and selected Environmental Consulting & Technology, Inc. for their proposed work plan, staff qualifications, past involvement with similar projects, and competitive fee schedule.
 
As part of an initial study, Environmental Consulting & Technology, Inc. reviewed existing information and data regarding Millers Creek, conducted a field reconnaissance of the site, identified and prioritized areas of high concern, and developed conceptual design alternatives for stabilizing the banks.  A Professional Services Agreement with Environmental Consulting & Technology, Inc. for $24,541.00 was established in order to perform this initial study phase and to develop a more detailed scope of work.  This PSA was amended by $97,440.00 on April 3, 2007 (Amendment No. 1) to include the complete design work for the project.
 
Amendment No. 2 to the existing PSA with Environmental Consulting & Technology, Inc. will include field engineering, construction inspection, and contract administration services for the construction phase of the project.
 
Environmental Consulting & Technology, Inc. received Human Rights and Living Wage approval on June 2, 2008.  
 
Sufficient funds are available in the Millers Creek Bank Stabilization Hubbard to Glazier project budget for the professional engineering services included in the proposed amendment to the Professional Services Agreement.  Funding for the project was appropriated to the project on June 18, 2007 from the FY 2007 Water Utilities - Storm Water Operating & Maintenance Fund, and the FY 2008 Water Utilities - Storm Water Operating & Maintenance Fund.

Whereas, On February 1, 2007, the City entered into an agreement with Environmental Consulting & Technology, Inc. in the amount of $24,541.00 for preliminary study and planning for the project;
 
Whereas, On April 3, 2007, City Council approved Amendment No. 1 with Environmental Consulting & Technology, Inc. and expanded the scope of services to include full design engineering services, and increased the PSA by the amount of $97,440.00.
 
Whereas, Amendment No. 2 to the existing Professional Services Agreement with Environmental Consulting & Technology, Inc. will include field engineering, construction inspection, and contract administration services for the construction phase of the project;
 
Whereas, Environmental Consulting & Technology, Inc. received Human Rights and Living Wage approval on June 2, 2008; and
 
Whereas, Funding for this amendment is available in the Millers Creek Bank Stabilization - Hubbard to Glazier project budget;
 
RESOLVED, That City Council approves Amendment No. 2 to the Professional Services Agreement with Environmental Consulting & Technology, Inc. in the amount of $170,278.00.
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said agreement after approval as to form by the City Attorney and approval as to substance by the City Administrator;
 
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution; and
 
RESOLVED, That a contingency amount of $10,000.00 be established within the project budget and that the City Administrator be authorized to approve additional Amendments to the Professional Services Agreement with Environmental Consulting & Technology, Inc., not to exceed $10,000.00 in order to satisfactorily complete this project.
