Resolution to Approve a Professional Services Agreement for Construction Materials Testing with Testing Engineers & Consultants, Inc. for the Miller - Maple Transmission Water Main Project (RFP No. 692, $77,910.00)

Attached for your review and approval is a resolution to authorize a Professional Services Agreement with Testing Engineers & Consultants, Inc. (TEC) for construction materials testing services in the amount of $77,910.00 for the Miller - Maple Transmission Water Main Project.
This project includes the construction of approximately 9,834 LF of 24" Water Main and appurtenances, 2,800 LF Storm Sewer, 2,030 LF of sludge discharge force main, and all related work. In addition, this work includes approximately 2,400 LF of curb and gutter and full or partial width of full depth road reconstruction. The construction is scheduled April 2008 through October 2008.
We received proposals from eleven firms for the required construction materials testing services. Project Management staff evaluated the proposals and selected TEC based on the proposal, staff qualifications, past involvement with similar projects, and cost. TEC received Human Rights and Living Wage approval on January 23, 2008.
Services to be performed include all the required testing for soils, aggregate, asphalt, and concrete. Funds for the requested services are available in the project budget for the Miller - Maple Transmission Water Main Project.

Whereas, It is necessary to retain a qualified testing firm to perform testing services for the Miller - Maple Transmission Water Main Project;
Whereas, Proposals were received by Procurement and evaluated by Project Management staff on the basis of staff qualifications, past involvement with similar projects, proposed work plan, and cost;
Whereas, Testing Engineers & Consultants, Inc. of Ann Arbor, Michigan has submitted to the City a proposal for the necessary services, setting forth the services to be performed by said firm and the payments to be made by the City therefore, all of which are agreeable to the City;
Whereas, Testing Engineers & Consultants, Inc. received Human Rights and Living Wage approval on January 23, 2008; and
Whereas, The required funds for the construction materials testing services are available in the project budget for the Miller - Maple Transmission Water Main Project;
RESOLVED, That a Professional Services Agreement with Testing Engineers & Consultants, Inc. in the amount of $77,910.00 be approved for construction materials testing services for the Miller - Maple Transmission Water Main Project;
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said agreement after approval as to form by the City Attorney and approval as to substance by the City Administrator;
RESOLVED, That a contingency amount of $ 12,344.00 be established within the project budget and that the City Administrator be authorized to approve additional change orders to the construction contract with the Testing Engineers & Consultants, Inc., not to exceed $ 12,344.00 in order to satisfactorily complete the project; and
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
