Attached for your review and approval please find a resolution that will approve an amendment to our existing professional services agreement (PSA) between the City of Ann Arbor and Inspection Services Company, Inc. (ISC) for professional engineering and material testing services in conjunction with the above referenced project.  
 
The amendment in the amount of $5,000.00 with ISC is for additional testing services that are required in order to successfully complete the construction of the project.  These additional services were required to inspect the handrails that were fabricated for the project.  Unfortunately, the handrails were originally fabricated with several defects that were not detectable during the original fabrication process that related to the railing "fit-up".  After reviewing the repair options, the Contractor ultimately decided that it would be more cost-effective to have the handrails re-fabricated rather than repair them.  We believe this approach provided the best product for us.  Unfortunately, it was necessary to perform all needed inspections throughout the entire fabrication process again.
 
We have discussed this matter with the general contractor and have informed him that the cost of the re-inspections should be borne by them.  The Contractor has agreed to this stipulation and we have processed the necessary change orders to deduct the costs of the handrail re-inspections from their contract.  This amounted to $9,729.45.
 
Council approved the original PSA with ISC on January 18, 2005, in the amount of $73,023.00.  Council also approved Amendment No. 1 (in the amount of $35,000.00) with ISC on October 4, 2005 and Amendment No. 2 (in the amount of $15,000.00) on February 5, 2007.  ISC has current human rights and living wage approval.
 
Funds to cover the cost of the additional services being requested here will come from the previously approved project budget.

Whereas, Professional engineering and material testing services are for the Huron Parkway Reconstruction Project - Phase V;
 
Whereas, It is now necessary to amend the existing professional services agreement with Inspection Services Company, Inc. to compensate them for the additional work tasks that are necessary to complete the material testing and inspection portion of the project; and
 
Whereas, Inspection Services Company, Inc. received Human Rights approval on March 5, 2008;
 
RESOLVED, That Council approves Amendment No. IIII to a Professional Services Agreement with Inspection Services Company, Inc., in the amount of $5,000.00 for the Huron Parkway Reconstruction Project - Phase V;
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said amendment after approval as to form by the City Attorney and approval as to substance by the City Administrator; and
 
RESOLVED, The City Administrator be authorized to take the necessary administrative actions to implement this resolution.
