Memorandum
There is a resolution before you to accept an easement for sanitary sewer from Trinity Evangelical Lutheran Church of Ann Arbor, a Michigan non-profit corporation, for the construction and maintenance of a sanitary sewer.
The easement is in standard form and conveyed without cost to the City.
Acceptance of the easement is recommended.

Whereas, Trinity Evangelical Lutheran Church of Ann Arbor, a Michigan non-profit corporation, is the owner in fee simple of property located in the City of Ann Arbor, Washtenaw County, Michigan, as described in the Washtenaw County Records at Liber 785, Pages 639 thru 651;
Whereas, A Resolution of the Church Council of Trinity Evangelical Lutheran Church of Ann Arbor, dated March 19, 2008, authorized the delivery of an easement to the City for the construction and maintenance of a municipally operated public service comprising the public utilities system to run with the land and burden the respective property perpetually; and
Whereas, Trinity Evangelical Lutheran Church of Ann Arbor has delivered an easement to the City for the construction and maintenance of a municipally operated public service comprising the public utilities system to run with the land and burden the respective property perpetually, being more particularly described as follows:
Description of sanitary sewer easement:
Commencing at the East 1/4 Corner of Section 31, T2S, R6E, City of Ann Arbor, Washtenaw County, Michigan; thence N00°13'30"W 1.75 feet along the East line of said Section; thence S88°43'15"W 959.20 feet along the Northerly right-of-way line of Stadium Boulevard; thence N00°46'13'W 76.65 feet along the Westerly line of "VAN DUSEN SUBDIVISION" as recorded in Liber 11 of Plats, Pages 34 and 35, Washtenaw County Records to the POINT OF BEGINNING; thence S89°13'47"W 25.00 feet; thence N00°46'13"W 620.85 feet; thence N88°43'15"E 25.00 feet along the Southerly line of "SCHUMACHER SUBDIVISION" as recorded in Liber 15 of Plats, Page 30, Washtenaw County Records; thence S00°46'13"E 621.07 feet along the Westerly line of said "VAN DUSEN SUBDIVISION" to the Point of Beginning. Being a part of the Northeast 1/4 of Section 31, T2S, R6E, City of Ann Arbor, Washtenaw County, Michigan and containing 15,524 square feet of land, more or less. Being subject to easements and restrictions of record if any.
RESOLVED, That the City hereby accepts said grant of easement.
