Resolution to Approve Temporary Closure of One Northbound Lane of South Main Street, Adjacent to Michigan Stadium

Whereas, The University of Michigan is undertaking a major reconstruction of portions of the football stadium located at the northeast corner of Stadium and South Main;
 
Whereas, Construction activities involve building a four-story wall on the west side of the stadium, adjacent to Main Street;
 
Whereas, Because of space and safety considerations related to the construction of this wall, the University has requested the City's permission to close a portion of northbound Main Street, adjacent to Michigan Stadium, beginning on or about May 1, 2008 and continuing for a period of approximately 15 months;
 
Whereas, The University has contracted for a construction schedule that anticipates construction activities starting as early as 6:00 a.m. and ending as late as 10:00 p.m., as many as seven days a week;
 
Whereas, The construction work schedule has been recently modified to begin at 7:00 a.m., but to run as late as 11:00 p.m.; and
 
Whereas, This work schedule and related noise is disturbing to the neighbors living in this part of the City and violates the City's noise ordinance;
 
RESOLVED, The City Administrator is authorized to issue a permit to the University of Michigan, as requested, for the temporary closure of a northbound lane of South Main Street, adjacent to the Michigan Stadium, subject to the following:
·      All work related to the remodeling and reconstruction of the Michigan Football Stadium shall be conducted in compliance with the City's noise ordinance.
·    The University and its contractor(s) will assure that heavy trucks serving the Stadium construction site will not travel northbound on Main Street beyond Pauline Avenue, nor southbound on Main Street between Huron and Madison.  
·    The University will reimburse to the City 100% of the costs of:
o      Traffic management required to effectively move traffic around the requested lane closure, including time, materials and equipment.
o      Excess wear and tear on area streets caused by heavy equipment serving the site.
o      Traffic calming, signal modifications or other measures required to properly manage detouring traffic on nearby streets.
·      The University will deposit with the City an amount equal to the estimated costs for the street and traffic expenses identified above.
·      Periodic reviews of compliance with the conditions of this permit will be evaluated by City staff.  If it is found that substantial compliance has not been attained, this permit for temporary street closure shall be revoked.
·      The requested street closure will not be valid during Art Fair.
·      The University will not work Sundays, the Memorial Day Holiday weekend and the 4th of July, except as follows for Sunday work:
o      Realizing that construction schedules may lag and there may be a time when Sunday construction is needed, the University will notify the City of the need for Sunday construction work and the City Administrator will approve the Sunday construction and notify Council of the work on Sunday.
o      Notification to the City is needed in order for the City to notify residents.
·      The University will do their utmost to restrict noise between 8-10 p.m. on weekdays (Monday through Saturday) and that there will be no noise from this site after 10 p.m.
    
RESOLVED, This permit will be valid only after execution of a written agreement between the University and the City, which agreement documents the normal permit terms and the special conditions identified above; and
 
RESOLVED, That the University has until May 1, 2008 to reach an agreement with the City under these criteria, and the City Administrator and City Attorney will report back to City Council on the arrangement that was reached by May 5, 2008.
