Memorandum
Attached for your review and action is a resolution to approve a contract with CXT Precast Products for $140,012.53 to supply and install prefabricated restrooms and a storage structure at Bandemer and Olson Parks per RFP #658 and to establish a total construction project budget of $154,013.00 which includes a $14,000.47 (10%) contingency.
 
An updated Bandemer Master Plan was approved by the Parks Advisory Commission at their June 19, 2007 meeting.  Development of Bandemer Park has been completed in multiple phases over the past 17 years.  Initial renovations in the northern portion of the property were completed 1991.  Improvements included the construction of a picnic shelter, parking, and walking trails.  In 2003 a non-motorized trail was constructed to connect the north and south areas of the park.  The non-motorized trail also serves as a connection in the Washtenaw County Border to Border Trail.  As the tenants' leases have expired and portions of the southern property have become accessible, limited restoration work has been completed including removal of fencing and concrete slabs, demolition of structures, removal of unused electrical service, and abandonment of obsolete monitoring wells.  In 2007 a disc golf course was added at the site.  Further improvements that are planned for spring 2008 include reconfiguration of parking areas, provision of storm water gardens, construction of a dirt bike jump course, and improved landscaping.  Also included in the 2008 development is the purchase and installation of two prefabricated restroom facilities, one in the north area of the park and one in the south area of the park, and purchase and installation of a prefabricated storage building that will be leased to the Ann Arbor Rowing Club for storage of their lifejackets, oars, and other equipment.  The City currently leases a pole barn structure to the Club for boat storage and the existing lease agreement will be amended to include the proposed equipment storage structure.  The permanent restroom structures are better able to accommodate the increasing number of park patrons in Bandemer Park and the structures are more cost effective than the portable restrooms that have been used in prior years.  A total of $109,705.40, including a portion of the contingency, for the purchase and installation of two prefabricated restroom structures and one prefabricated equipment storage structure for Bandemer Park is included in the FY 08 Bandemer Park Project in the Park Rehabilitation and Development Millage Fund budget.
 
The Olson Park Master Plan was approved by the Parks Advisory Commission and City Council in 2001.  Development of Olson Park was completed between 2001 and 2003. Park improvements included the installation of soccer fields, walking paths, mountain bicycle trails, play area, picnic shelter, dock, and landscaping.  An off-leash dog area was added in 2007.  Remaining improvements at Olson Park include completing the asphalt paving of the existing parking lot, landscaping, and installing a restroom facility.  A permanent restroom structure will better serve the increasing number of park users at Olson Park and the permanent structure is more cost-effective than the portable restrooms that have been used in prior years.  A total of $44,307.60, including a portion of the contingency, for the purchase and installation of one prefabricated restroom structure in Olson Park is included in the FY 08 Olson Park Project in the Park Rehabilitation and Development Millage budget.
 
Bid documents were advertised on MITN and sent to vendors specializing in prefabricated restroom structures.  A total of three bids were received for the project including the following:

The resolution includes a recommended construction contingency of $14,000.47 (10%) to cover potential contract change orders to be approved by the City Administrator.  It is requested that a $154,013.00 total construction project budget be established for the life of the project without regard to fiscal year.
 
CXT Precast Products, Inc. meets the living wage and prevailing wage requirements and received Human Rights approval on January 16, 2008.

Whereas, Bandemer Park was identified in the 2000-2005 Park and Recreation Open Space Plan to receive upgrades and improvements in FY 06;
 
Whereas, The Master Plan for Bandemer Park includes permanent restroom facilities to serve the increased number of park patrons who are involved with recreational activities including rowing, disc golf, bicycling, picnicing, and walking/jogging;
 
Whereas, Olson Park was identified in the 2000-2005 Park and Recreation Open Space Plan to receive upgrades and improvements in FY 06;
 
Whereas, The Master Plan for Olson Park includes permanent restroom facilities to serve the soccer fields and picnic shelter, mountain bicycling and other park users;
 
Whereas, Competitive bids were sought by the Procurement Office with bids received on January 3, 2008 and CXT Precast Products was identified as the lowest responsible bidder;
 
Whereas, Funds in the amount of $109,705.40 for the Bandemer Park Project and $44,307.60 for the Olson Park Project are included in the FY 08 Park Rehabilitation and Development Millage budget; and
 
Whereas, CXT Precast Products received Human Rights approval on January 16, 2008 and complies with the living wage and prevailing wage requirements;
 
RESOLVED, That City Council approve a contract, per RFQ #658, with CXT Precast Products in the amount of $140,012.53, a construction contingency of $14,000.47 (10%) to cover potential contract change orders, for a total construction project budget of $154,013 for the life of the project without regard to fiscal year with $109,705.40 from the Bandemer Park Project and $44,307.60 from the Olson Park Project in the Park Rehabilitation and Development Millage;
 
RESOLVED, That the City Administrator is authorized to take all necessary administrative actions to implement this resolution including the authority to approve change orders within the approved contingency; and
 
RESOLVED, That the Mayor and City Clerk are authorized and directed to execute the contract after approval as to substance by the City Administrator and approval as to form by the City Attorney.
