Memorandum
Attached for your review and approval is a resolution to award a contract to Bricco Excavating Company, L.L.C. in the amount of $482,069.50 for the S. Ashley, S. Main & Londonderry Water Main Project.
 
The construction contract titled "S. Ashley, S. Main & Londonderry Water Main Projects" includes the installation of new 8" & 12" water main replacements at three different locations in the City: S. Ashley, S. Main & Londonderry. It also includes new storm sewer at Londonderry Road and Riverview Drive.  The work at these locations is combined in one construction contract for efficiency and cost savings.
 
The S. Ashley and S. Main water main work includes the installation of approximately 240 feet of new 8" HDPE water main on S. Ashley, and 230 feet of new 12" HDPE water main on S. Main to replace the existing 6" water main that currently goes under the Ann Arbor Railroad tracks.  This section of pipe has a history of water main breaks that have disrupted service.  This work will provide a more reliable water service for the neighborhood, and conform to City of Ann Arbor water main and fire protection standards by upsizing the pipe and adding a fire hydrant.  Adjacent sidewalk ramps will be replaced to comply with the ADA requirements.
 
The Londonderry Road work includes the installation of approximately 410 feet of new 8" ductile iron water main to replace an existing 6" water main to serve houses on Londonderry.  This work will provide a more reliable water service for the neighborhood, and conform to City of Ann Arbor water main and fire protection standards by providing a looped main, and adding two fire hydrants.  It also includes 450 feet of new storm sewer to connect two unconnected sections of storm sewer.  
 
The Riverview Road work includes the installation of approximately 250 feet of new storm sewer to improve drainage.  
 
A new fire hydrant on Exmoor Road is also included in the work to address neighborhood water quality complaints.  Water Quality in this area deteriorates because of low flow. The installation of the hydrant allows for periodic flushing.
 
The project was advertised on Bidnet and plans and specifications were distributed to contractors who expressed interest in the project. Six bids for the construction were received and opened on Thursday, March 12, 2009. The low bid from Bricco Excavating Company, L.L.C. of $482,069.50 is approximately 7% under the Engineer's Estimate. The construction of the project is scheduled for completion by November 2009.  
 
The funding for $565,000.00 of this project will be advanced from the Water System Operating Fund pending the sale of Water Revenue bonds.  Funding for $150,000.00 of this project will be advanced from the Storm Water Operating Fund pending the sale of Storm Water Revenue bonds.

Bricco Excavating Company, L.L.C. received Human Rights approval on March 16, 2009. Employees working on this project will be paid prevailing wages (which exceed the "living wage") per the contract.

Whereas, It is necessary to install new water mains in S. Ashley, S. Main & Londonderry Road to provide safe and dependable water service for these residences;
 
Whereas, It is necessary to install new storm sewers in Londonderry Road and Riverview Drive to provide drainage;
 
Whereas, Competitive bids were received by the Procurement Unit on March 12, 2009 and Bricco Excavating Company, L.L.C. of Oak Park, MI, was the lowest responsible bidder at $482,069.50;
 
Whereas, The contractual proposal sets forth the services to be performed by said company, and the payments to be made by the City therefore, all of which are agreeable to the City;
 
Whereas, It is now necessary to enter into a contract with said company for said construction project; and
 
Whereas, Bricco Excavating Company, L.L.C. received Human Rights approval on March 16, 2009 and complies with the living wage ordinance; and
 
Whereas, Funding for $565,000.00 of this project will be advanced from the Water System Operating Fund pending the sale of Water Revenue bonds; and
 
Whereas, Funding for $150,000.00 of this project will be funded from the approved FY 09 Storm Water Capital Budget;
 
RESOLVED, That a contract in the amount of $482,069.50 be awarded to Bricco Excavating Company, L.L.C. for the construction of the S. Ashley, S. Main & Londonderry Water Main Project (Bid No. ITB-3992);
 
RESOLVED, That a contract contingency amount of $48,200.00 be established and that the City Administrator be authorized to approve additional change orders to the construction contract with Bricco Excavating Company, L.L.C., not to exceed $48,200.00 in order to satisfactorily complete this project;
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said contract after approval as to form by the City Attorney, and approval as to substance by the City Administrator;
 
RESOLVED, That the City make the following declaration for the purpose of complying with the reimbursement rules of Treasury Regulations 1.150-2 pursuant to the Internal Revenue Code of 1986, as amended, that the City reasonably expects to reimburse itself for expenditures for the costs of the Project with proceeds of Bonds; and
 
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
