Memorandum
There is a resolution before you to accept an easement for public road right-of-way from Plymouth Road Ventures, LLC, a Michigan limited liability company, for the maintenance of public roads.
 
The easement is in standard form and conveyed without cost to the City.
 
Acceptance of the easement is recommended.

Whereas, Plymouth Road Ventures, LLC, a Michigan limited liability company, is the owner in fee simple of property located in the City of Ann Arbor, Washtenaw County, Michigan as described in the Washtenaw County Records at Liber 4536, Page 340, recorded February 1, 2006 and at Liber 4536, Page 341, recorded February 1, 2006;
 
Whereas, The Company's Operating Agreement, dated September 28, 2006, authorizes the delivery of a perpetual easement to the City for public road right-of-way along the north side of Plymouth Road; and
 
Whereas, Plymouth Road Ventures, LLC, a Michigan limited liability company, has delivered an easement to the City for public road right-of-way to run with the land and burden the respective property perpetually, being more particularly described as follows:
Description of Plymouth Road ROW
 
Commencing at the NW corner of Section 22, T2S, R6E, City of Ann Arbor, Washtenaw County, Michigan, being the NW corner of Uplands Subdivision as recorded in Liber 5 of Plats, Page 41, Washtenaw County records; thence S 88°21'30" E 656.86 feet along the north line of said Section 22 and the north line of Said Subdivision, as monumented; thence S 2°20'32 W 1402.45 feet along the east line of said subdivision to the Point of Beginning; thence continuing S 2°20'32 W 18.57 feet along the east line of said subdivision; thence S 68°38'04" W 165.54 feet along the south line of Lots 10 & 11 of said subbdivision and along the northern right-of-way line of Plymouth Road (variable width);  thence N 2°19'55" E 15.55 feet along the west line of Lot 11 of said Subdivision; thence 37.00 feet along the arc of a 666.65 foot radius circular curve to the right, with a central angle of 3°10'49", having a chord which bears S 73°24'25" W 37.00 feet along the northern right-of-way line of Plymouth Road (variable width); thence N 2°19'55" E 2.53 feet along the west line of the east 35.00 feet of Lot 12 of said Subdivision; thence 30.27 feet along the arc of a 664.24 foot radius circular curve to the left, with a central angle of 2°36'39", having a chord which bears N 73°37'36" E 30.26 feet; thence N 68°38'04" E 172.46 feet to the Point of Beginning, being part of Lots 10, 11 & 12 of Uplands Subdivision as recorded in Liber 5 of Plats, Page 41, Washtenaw County records in the NW 1/4 of Section 22, T2S, R6E, City of Ann Arbor, Washtenaw County, Michigan Containing 0.07 acres of land, more or less.  Subject to easements and restrictions of record, if any.
 
RESOLVED, That the City hereby accept said grant of easement.
