Memorandum
Attached for your review and approval is a resolution to award a construction contract to Ajax Paving Industries, Inc. in the amount of $2,422,403.75 for the 2009 Major Street Resurfacing Program.  The project will accomplish the resurfacing of approximately six major streets located throughout the City.
 
We have attached a street list, showing the general order in which the streets will be repaired and a brief summary of the scope of each project.  Construction is scheduled to begin April 20, 2009 and to be completed in October 2009.
 
Plans and specifications were made available through BidNet.  Three bids were received and opened on March 3, 2009.  The lowest responsible bid, in the amount of $2,422,403.75 is $254,596.00 lower than the engineer's estimate of $2,677,000.00.  A tabulation of the bids is also attached.
 
Also included in this contract will be the installation of a pedestrian refuge island on Seventh Street at Washington Street to provide better pedestrian access across Seventh Street.  This work will be scheduled to best coordinate with the ongoing operations on the other streets.  
 
Ajax Paving Industries, Inc. received Human Rights approval on March 3, 2009.  All employees of Ajax Paving Industries, Inc., who will work on the project, will receive compensation in accordance with the Living Wage Ordinance.

Whereas, The City of Ann Arbor Adopted 2009 Capital Budget includes the Annual Major Street Resurfacing Program;
 
Whereas, The 2009 Major Street Resurfacing Program is necessary to maintain quality streets in the City of Ann Arbor;
 
Whereas, Competitive bids were received by Procurement on March 3, 2009 and Ajax Paving Industries, Inc. was the lowest responsible bidder at $2,422,403.75;
 
Whereas, The contractual proposal sets forth the services to be performed by said company, and the payments to be made by the City therefore, all of which are agreeable to the City;
 
Whereas, It is now necessary to enter into a Contract with said company for said construction project; and
 
Whereas, Ajax Paving Industries, Inc. received Human Rights approval on March 3, 2009, and its employees will receive compensation in accordance with the Living Wage Ordinance;
 
RESOLVED, That a contract in the amount of $2,422,403.75 be awarded to Ajax Paving Industries, Inc. for the construction of the 2009 Major Street Resurfacing Program;
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said contract after approval as to form by the City Attorney, and approval as to substance by the City Administrator;
 
RESOLVED, That the following project budget be adopted for the life of the project, to be available without regard to fiscal year:
 
RESOLVED, That a contingency amount of $200,000.00 be established within the project budget and that the City Administrator be authorized to approve additional change orders to the construction contract with Ajax Paving Industries, Inc., not to exceed $200,000.00 in order to satisfactorily complete this project; and
 
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
