Memorandum
This is to recommend approval of the attached resolution authorizing an amendment to the Professional Services Agreement with CDM Michigan, Inc. (CDM) for design and construction engineering services performed for the Swift Run Parallel Relief Sewer.  CDM's services are now complete and this amendment authorizes payment for additional costs associated with engineering services required as detailed below.
 
Project Background
The project consisted of constructing a 27" diameter parallel relief sewer to the Swift Run Sanitary Trunk Sewer to provide capacity for peak and predicted future flows.  During wet weather, overflows had occurred in the trunkline.  This parallel sewer was constructed in Pittsfield and Ann Arbor Townships.  Construction of this improvement was required by MDEQ under the terms of the Administrative Consent Order to address sanitary sewer overflows.
 
Design Contract
In November 2000, the contract for design of the improvements was awarded to CDM Michigan, Inc.  However, due to ongoing conversations between the City and Shetland Drive residents regarding Outside City Service Agreements for sewer service, the project was put on hold and CDM's purchase order was closed.  The issues were later resolved and in March 2006, CDM's contract was reopened and amended to include easement-related work (R-101-3-06).  In August 2008, CDM's agreement was amended a second time to include construction engineering, inspection, and staking of construction.  
 
Proposed Amendment 3
The proposed amendment will allow payment of work completed by CDM which was in addition to the previously approved contract scope.  CDM provided additional work for the following tasks:
 
·      Permit Support and Drawing Revisions
·      Additional Survey Activities
·      Additional Construction Inspection
 
As described in a separate memorandum Council (File 10-0093 - Resolution to Change Order to CI Contracting, Inc.), changes and additional work were necessary during the construction phase of this project.
 
-      Permit Support and Drawing Revisions ($18,700.00).  Because the project took place within Pittsfield and Ann Arbor Townships, those agencies oversaw much of the construction.  The Washtenaw County Water Resources Commission also issued a permit for work within the Swift Run Stream.  Prior to construction, communication with each agency indicated that the permit requirements would be met with the design as shown.  However, each of the permitting agencies requested additional work to be completed as a condition of the construction permits.  This resulted in additional construction engineering for CDM.
 
-      Surveying ($11,360.00).  Surveying and staking costs were higher than originally expected.  Out of scope work included preparing additional private property easement sketches at the request of Ann Arbor Township, re-staking due to construction delays (weather and dewatering), staking of construction field changes, and grade verifications of an existing privately-owned bridge.
 
-      Extended Construction Engineering and Inspection ($19,225.00).  A number of issues with the construction of the sewer resulted in the project extending beyond the original contract time, including dewatering requirements and wetland mitigation efforts.  Construction inspection and meeting with the residents and township officials was ongoing during the extended time period which resulted in additional efforts by CDM.
 
The total amount requested for Amendment 3 is $49,285.00.  This will be in addition to CDM's previously approved contract amount of $282,846.00 for a total contract amount of $332,131.00.

Whereas, The Swift Run Parallel Relief Sewer was constructed to address sanitary sewer overflows within the City's sanitary sewer system;
 
Whereas, CDM Michigan, Inc. has an existing Professional Services Agreement with the City of Ann Arbor in the amount of $282,846.00 for design and construction engineering of the Swift Run Parallel Relief Sewer Project;
 
Whereas, Additional work was necessary due to design and construction related items that resulted in costs of $49,285.00 to CDM Michigan, Inc.; and
 
Whereas, Funds for the amendment are available in the approved capital budget budget;
 
RESOLVED, That the City Council authorize an amendment to the professional services agreement with CDM Michigan, Inc. in the amount of $49,285.00 for a total contract amount of $332,131.00 for design and construction engineering services for the Swift Run Parallel Relief Sewer project;
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said amendment after approval as to form by the City Attorney, and approval as to substance by the City Administrator;
 
RESOLVED, That the City make the following declaration for the purpose of complying with the reimbursement rules of Treas. Reg. 1.150-2 pursuant to the Internal Revenue Code of 1986, as amended, that the City reasonably expects to reimburse itself for expenditures for the costs of the Project with proceeds of Bonds; and
 
RESOLVED, That Council authorize the City Administrator to take necessary administrative actions to implement this resolution.
