Attached for your review and approval is a resolution to approve an amendatory grant contract with the Michigan Department of Transportation-Bureau of Aeronautics (MDOT-Aero), including the Terms and Conditions of Accepting Airport Improvement Program Grants required by the Federal Aviation Administration (FAA), in the amount of $5,200.00 for the completion of a construction project at the airport.  
 
Council approved grant contract #2010-0280 with MDOT-Aero in March, 2010 in the amount of $88,000.00 to complete three projects.  This work included an upgrade to airfield signage, upgraded pavement markings on the airfield, and completion of an Exhibit "A" property survey.  Competitive bids were solicited and awarded last summer.  The bids came in higher than expected and MDOT-Aero applied their 15% contingency to increase the project total to $101,200.00.
 
Additional pavement marking were requested by the FAA Air Traffic Control Tower and unplanned maintenance work was done on an existing airport lighting system by the contractor.  This additional work would normally come directly from airport operating funds but since the work is grant eligible, MDOT-Aero agreed to fund it.  Utilizing the grant, the actual cost to the airport for the extra work comes to $130.00 versus the full $5,200.00.  This change increased the overall project budget by $5,200.00 necessitating an amendment to the MDOT-Aero grant contract.
 
The amended grant amount of $106,400.00 is comprised of $101,080.00 in federal funds, $2,660.00 in state funds and $2,660.00 in airport matching funds.  The airport's share of this grant is included in the airport's current operating budget.  All funding (local, state and federal) for this project will come from fees paid by users of aviation industry services.  The grant is administered by MDOT-Aero and they make payments directly to the contractor for grant eligible expenses.

Whereas, The Airport determined there was a need to upgrade airfield signage, pavement markings and complete an Exhibit 'A" property survey to ensure compliance with current Federal Aviation Administration (FAA) design requirements;
 
Whereas, The FAA, MDOT-Aero and the City approved a grant agreement in March, 2010 to fund and support the project;
 
Whereas, additional work was undertaken as part of the airfield signage and pavement marking upgrades portions of the project and additional funds in the amount of $5,200.00 are necessary to close out the project;
 
Whereas, MDOT-Aero has provided an amendatory grant, including the Terms and Conditions of Accepting Airport Improvement Program Grants required by the FAA, in the amount of $5,200.00 and will administer the grant, including making payments for services directly to the contractor or consultant(s);
 
Whereas, the local matching funds ($130.00) for this amendatory agreement are available in the Airport operating budget;
 
RESOLVED, That the City Council approve amendatory grant contract number 2010-0280/A1 with the Michigan Department of Transportation, including the Terms and Conditions of Accepting Airport Improvement Program Grants required by the FAA, in the revised total amount of $106,400.00 for airfield signage, pavement marking upgrades and the completion of an Exhibit "A" property survey and map at the Ann Arbor Municipal Airport,
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to sign said agreement upon approval as to form by the City Attorney, and upon approval as to substance by the City Administrator; and
 
RESOLVED, That the City Administrator be directed to take the necessary administrative actions to implement this resolution.
