Memorandum

Attached for your approval is a resolution to award a construction contract to Bailey Excavating, Inc. (Bailey), in the amount of $2,544,692.24, for the 2021 Miscellaneous Utilities Project.

 

Project Description

 

This project includes three separate areas of work, which were combined into one contract for cost saving purposes. The three locations included are as follows:

  

                     N. Main Street - Construction of a new storm sewer from a manhole at the edge of Bluffs Park to the railroad and abandonment of old storm sewer running underneath buildings at 1251 and 1250 N. Main Street.

                     Bird Road at Newport Road - Replacement and relocation of pressure reducing valve, including construction of a vault and adjacent piping.

                     W. Liberty St. and Crest Ave.- Replace and upsize water mains on W. Liberty St. from S. Seventh St. to Crest Ave., and on Crest Ave. from W. Liberty St. to Buena Vista. Full width pavement resurfacing is included in the scope.

 

The City published plans and specifications through its procurement website and MITN.info and received two bids on April 15, 2021. Bailey was the lowest responsible bidder at $2,544,692.24, which is 14% above the Engineer’s Estimate. A summary of the bids is attached.

 

Bailey submitted all required Responsible Contractor Criteria, Non-Discrimination, Prevailing Wage, Living Wage, and Conflict of Interest Disclosure forms; and complies with the requirements of the City’s Responsible Bidder, Non-Discrimination, and Living Wage ordinances.

 

Budget/Fiscal ImpactThe current Capital Improvements Plan (CIP) includes the N. Main Street Storm Sewer Relocation (UT-ST-18-17), the Bird Road Valve Replacement (UT-WS-16-21), and the W. Liberty Street and Crest Avenue Water Main Replacements (UT-WS-14-07). Funding is available in the approved Stormwater Sewer System and Water Supply System Capital Budgets.

Whereas, The 2021 Miscellaneous Utilities Project will provide safer storm water conveyance on N. Main Street; more reliable and efficient water service in the vicinities of Bird and Newport Roads, and W. Liberty Street and Crest Avenue;

 

Whereas, These projects are included in the Capital Improvements Plan and funding is available in the respective Storm Sewer System and Water Supply System approved Capital Budgets;

 

Whereas, Competitive bids were received by Procurement on April 15, 2021 (ITB No. 4669) and Bailey Excavating, Inc. was the lowest responsible bidder with a submitted bid of $2,544,692.24;

 

Whereas, The proposed contract sets forth the services to be performed and the payments to be made, all of which are agreeable to the City;

 

Whereas, It is now appropriate to enter into a Contract with said company for this construction project; and

 

Whereas, Bailey Excavating, Inc. has submitted all required Responsible Contractor Criteria, Non-Discrimination, Prevailing Wage, Living Wage, and Conflict of Interest Disclosure forms and complies with the requirements of the City’s Responsible Bidder, Non-Discrimination, and Living Wage ordinances;

 

RESOLVED, That a construction contract in the amount of $2,544,692.24 be awarded to Bailey Excavating, Inc. for the construction of the 2021 Miscellaneous Utility Improvements project;

 

RESOLVED, That a contingency amount of $250,000.00 be established within the project budget and that the City Administrator be authorized to approve change orders to the construction contract with Bailey Excavating, Inc. not to exceed that amount, in order to satisfactorily complete this Project;

 

RESOLVED, That the City make the following declaration for the purpose of complying with the reimbursement rules of Treasury Regulations 1.150-2 pursuant to the Internal Revenue Code of 1986, as amended, that the City reasonably expects to reimburse itself for expenditures for the costs of the Project with proceeds of Bonds;

 

RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said contract after approval as to form by the City Attorney and approval as to substance by the Public Services Area Administrator and City Administrator; and

 

RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution including approval of needed Traffic Control Orders, night work authorizations, and other similar administrative approvals to allow the work of the project to proceed without delay.
