Memorandum
There is a resolution before you to accept an easement for Public Utilities from the Public Schools of the City of Ann Arbor, a public body corporate organized and existing under the Michigan Revised School Code, for a public utilities system to be constructed on the Tappan Middle School property.

By agreement with the Public Schools as approved by Council on June 7, 2010 in R-10-165, the City agreed to the construction of water main improvements at the Tappan Middle School property as part of the larger Copley Avenue project.

The easement is in standard form and conveyed without cost to the City.

Acceptance of the easement is recommended.

Whereas, the Public Schools of the City of Ann Arbor, a public body corporate organized and existing under the Michigan Revised School Code, is the owner in fee simple of real property located at 2251 E. Stadium Boulevard, in the City of Ann Arbor, Washtenaw County, Michigan, commonly known as Tappan Middle School.

Whereas, the Public Schools of the City of Ann Arbor has delivered a permanent Public Utilities easement for lands located in the City of Ann Arbor, County of Washtenaw to the City, to run with the land and burden the respective property perpetually, being more particularly described as follows:

40 FT.WIDE UTILITY EASEMENT
Commencing at the Northwest corner of Lot 10 of “Assessor’s Plat No. 49” as recorded in Liber 17 of Plats, Pages 33 & 34 of Washtenaw County records, being a part of the South 1/2 of Section 34, T2S, R6E, City of Ann Arbor, Washtenaw County, Michigan; thence S47º 25’ 00”W 353.70 feet along the westerly line of Lot 10 of said Assessor’s Plat No. 49 to the PLACE OF BEGINNING; thence S 44º 40’ 17” E 28...
