Memorandum
There is a resolution before you to accept an easement for Public Utilities from the Public Schools of the City of Ann Arbor, a public body corporate organized and existing under the Michigan Revised School Code, for a public utilities system to be constructed on the Tappan Middle School property.
 
By agreement with the Public Schools as approved by Council on June 7, 2010 in R-10-165, the City agreed to the construction of water main improvements at the Tappan Middle School property as part of the larger Copley Avenue project.
 
The easement is in standard form and conveyed without cost to the City.
 
Acceptance of the easement is recommended.

Whereas, the Public Schools of the City of Ann Arbor, a public body corporate organized and existing under the Michigan Revised School Code, is the owner in fee simple of real property located at 2251 E. Stadium Boulevard, in the City of Ann Arbor, Washtenaw County, Michigan, commonly known as Tappan Middle School.
 
Whereas, the Public Schools of the City of Ann Arbor has delivered a permanent Public Utilities easement for lands located in the City of Ann Arbor, County of Washtenaw to the City, to run with the land and burden the respective property perpetually, being more particularly described as follows:
 
40 FT.WIDE UTILITY EASEMENT
Commencing at the Northwest corner of Lot 10 of "Assessor's Plat No. 49" as recorded in Liber 17 of Plats, Pages 33 & 34 of Washtenaw County records, being a part of the South 1/2 of Section 34, T2S, R6E, City of Ann Arbor, Washtenaw County, Michigan; thence S47º 25' 00"W 353.70 feet along the westerly line of Lot 10 of said Assessor's Plat No. 49 to the PLACE OF BEGINNING; thence S 44º 40' 17" E  281.69 feet; thence N 45º 19' 43" E  16.10 feet; thence S 44º 40' 17" E  40.00 feet; thence S 45º 19' 43" W  22.84 feet; thence S 06º 31' 19" W  36.36 feet; thence N 83º 28' 41" W  40.00 feet; thence N 06º 31' 19" E  25.85 feet; thence N 44º 40' 17" W  259.61 feet; thence S 44º 37' 26" W  152.95 feet; thence 154.19 feet along the arc of a 230.00 feet radius to the left, having a central angle of  38º 24' 40" and a chord of S 25º 25' 06" W  151.32 feet; thence S 06º 38' 23" W  149.10  feet; thence S 82º 26' 23" E  10.24 feet; thence S 07º 33' 37" W  40.00 feet; thence N 82º 26' 23" W  10.02 feet; thence S 07º 36' 48" W  43.24 feet; thence S 89º 15' 16" W  280.40 feet; thence N 45º 43' 07" W  42.28 feet to a point on the easterly line of Brockman Boulevard (66 ft. wd.), said point also being on the westerly line of Lot 24 of "Buell Subdivision No, 1" as recorded in Liber 6 of Plats, Page 51 of Washtenaw County records, thence along said westerly line of Lot 24 and said easterly line of Brockman Boulevard the following two (2) courses, 35.16 feet along the arc of a 286.70 feet radius to the right, having a central angle of  07º 01' 35" and a chord of N 48º 48' 20" E  35.14 feet and N 52º 19' 07" E  5.02 feet; thence S 45º 43' 07" E  22.23 feet; thence N 89º 15' 16" E  229.27 feet; thence N 07º 36' 48" E  33.50 feet; thence N 06º 38' 23" E  163.47 feet; thence 180.85 feet along the arc of a 270.00 feet radius to the right, having a central angle of  38º 22' 42" and a chord of N 25º 26' 06" E  177.49 feet; thence N 44º 37' 26" E  131.88 feet to the westerly line of  Lot 10 of said Assessor's Plat No. 49; thence along said westerly line N 47º 25' 00" E  61.60 feet to the PLACE OF BEGINNING. Being a part of Lot 10 of "Assessor's Plat No. 49", parts of Lots 22, 23 and 24 of "Buell Subdivision No, 1" and part of the South 1/2 of Section 34, T2S, R6E, City of Ann Arbor, Washtenaw County, Michigan and containing 1.10 acres of land, more or less.
Note: Bearings were based on the Assessor's Plat No. 49 as recording in Liber 17, Pages 33 & 34 of Washtenaw County records
 
RESOLVED, That the City of Ann Arbor hereby accepts said grant of easement.
