Resolution of Intent to Vacate Two Segments of Seybold Drive Adjacent to the Proposed Ann Arbor Housing Commission North Maple Road Development, 701 N. Maple Road (8 Votes Required)
Memorandum
The Ann Arbor Housing Commission requests the vacation of two segments of unimproved, platted Seybold Drive right-of-way to allow their North Maple Road site to be fully redeveloped. Currently, a 120-foot long segment of the platted Seybold Drive right-of-way extends into the site from the north and a 30-foot length extends into the site from the south. The middle 330-foot length of Seybold Drive was vacated in 1969 as part of the original Housing Commission development on this site. Vacation of the requested additional segments will make the site whole.
Project Management and Systems Planning Unit staff concur that this street vacation is acceptable because these segments do not serve any other platted lots or contain any public utilities serving any other lots.
Approval of this resolution announces the City's intent to vacate the described unimproved segments of the Seybold Drive right-of-way and serves as notification that City Council will hold a public hearing on this vacation on August 18, 2014. A resolution to approve the vacation also will be scheduled and placed on the August 18, 2014 Council agenda.
The Planning Commission held a public hearing on June 17, 2014 and recommended approval of the proposed street vacation. A map indicating the area proposed for vacation is attached.

Commencing at the NE corner of Lot 290 of "Scioto Hills Number One" Subdivision, Liber 8 of Plats, Page 30, Washtenaw County Records; thence N87°42'30"W 155.00 feet along the North line of said Lot 290; thence S01°31'00"W 120.00 feet along the West line of Lots 289-290 of said "Scioto Hills Number One" Subdivision; thence N87"42'30"W 155.00 feet along the North line of Lot 280 of said "Scioto Hills Number One" Subdivision; thence N01°31'00"E 60.00 feet along the East right-of-way line of Seybold Drive (50 feet wide) to the Point of Beginning;
thence N87°42'30"W 50.00 feet; thence N01°31'00"E 40.00 feet along the West right-of-line of said Seybold Drive (50 feet wide); thence S87°42'30"E 50.00 feet;

Whereas, Public Services Area staff have determined that the requested segments of the platted Seybold Drive right-of-way are not required for public access or utilities; and
Whereas, The Planning Commission recommended approval of the proposed street vacation on June 17, 2014;
RESOLVED, That City Council appoints August 18, 2014 at 7:00 p.m. in the Council Chamber, City Hall, Ann Arbor, Michigan, as the time and place City Council will meet to hear objections to the vacation of two segments of the unimproved, platted Seybold Drive right-of-way;
RESOLVED, That notice of such meeting, including a copy of this resolution, shall be published not less than four weeks before the time appointed for such meeting in a newspaper of general circulation in the City; and
RESOLVED, That objections to this proposed vacation may be filed with the City Clerk in writing and that all persons wishing to address the proposed vacation will be heard by the City Council at the public hearing noticed in this resolution.
