Memorandum
Attached for your review and approval is a resolution to purchase U.P.M. High Performance Cold Patch material from Barrett Paving Materials, Inc.  U.P.M. High Performance Cold Patch material is used by City forces in normal maintenance tasks associated with street repairs.  The U.P.M. High Performance Cold Patch material and conform to the latest Standard Specifications of the City and the Michigan Department of Transportation.
The Public Services Area solicited bids (Bid # ITB-4176) for U.P.M. High Performance Cold Patch material for the period of September 1, 2011 through August 31, 2013, subject to annual appropriation of funds.  Barrett Paving Materials, Inc. was the lowest responsible bidder.  
 
Sufficient funds for this purchase are budgeted within the Public Services, Field Operations Major and Local Street funds, Water Supply Systems, Sewage Disposal and Storm Sewer systems for FY12.  Future contract years are subject to City Council annual budget appropriation.  We anticipate an annual expenditure of up to $102,000.00 for each fiscal year.    
 
Barrett Paving Materials, Inc. received Human Rights approval on July 27, 2011.

Whereas, The City uses U.P.M. High Performance Cold Patch materials for normal maintenance of city streets;
 
Whereas, Competitive bids were sought for the supply of U.P.M. High Performance Cold Patch materials and Barrett Paving Materials, Inc. was the lowest responsible bid;
 
Whereas, The Public Services Area solicited bids, (Bid # ITB-4176) for U.P.M. High Performance Cold Patch materials for the period of September 1, 2011 through August 31, 2013, subject to annual appropriation of funds;
 
Whereas, The bid prices are firm through August 31, 2013;
 
Whereas, Barrett Paving Materials, Inc. received Human Rights approval on July 27, 2011;
 
Whereas, Sufficient funds have been budgeted in the FY12 Public Services Field Operations Major and Local Street Funds, Water Supply Systems, Sewage Disposal and Storm Sewer systems; and
 
Whereas, FY13 & FY14 purchases of up to $102,000.00 annually are to be funded from the Field Operations and Maintenance budgets if so approved by Council;
 
RESOLVED, That City Council authorize the purchase orders for U.P.M. High Performance Cold Patch materials from Barrett Paving Materials, Inc., for the period of September 1, 2011 through August 31, 2013 as needed, not to exceed $102,000.00 annually; and
 
RESOLVED, That City Administrator be authorized to take any necessary actions to implement this resolution.
