Resolution to Approve a Month-to-Month Lease with The Kiwanis Club of Ann Arbor Foundation, Inc. ("Kiwanis") for a Portion of the Bay Area at 415 W. Washington Street (8 Votes Required)

Whereas, The Kiwanis Club of Ann Arbor Foundation, Inc. ("Kiwanis") has requested and City Administration, after discussion, recommends the lease on a month-to-month basis of a portion of the bay area at 415 W. Washington St;
Whereas, City Council has previously identified this site for re-development, and the proposed lease of the property allows temporary income from the site until Council determines some other use for it; and
Whereas, The Kiwanis has reviewed and agreed to the conditions of tenancy;
RESOLVED, That City Council approve a month-to-month lease with The Kiwanis Club of Ann Arbor Foundation, Inc. effective September 7, 2011 at a rental rate of $100.00 per month during the life of their tenancy;
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute the lease document after approval as to substance by the City Administrator and approval as to form by the City Attorney; and
RESOLVED, That the City Administrator be authorized to take all necessary actions to implement this Resolution, including but not limited to authorizing the City Attorney to terminate the lease, if or when necessary.
