Resolution to Approve Amendment No. 1 to the Professional Services Agreement with Wade Trim, Inc. for Village Oaks - Chaucer Court Drainage Area Study ($13,000.00)

Attached for your review and approval, please find a resolution approving Amendment No. 1 to the professional services agreement for engineering services with Wade Trim, Inc. (Wade Trim) for the Village Oaks - Chaucer Court Drainage Area Study in the amount of $13,000.00.
During certain storm events, the area between the west boundary of the Village Oaks Subdivision and the east boundary of the Landsdowne Subdivision near Chaucer Court has experienced backyard flooding and occurrences of basement flooding. Reports of flooding in this area date back to the 1980's. A relief sewer was constructed in 1991 to address flooding issues in this area, but flooding problems have persisted. Working collaboratively with the local residents, a Request for Proposals was issued for engineering services to evaluate the watershed and make recommendations for improvements. The city received proposals from nine consulting engineering firms for the requested study. A selection committee comprised of city staff and representatives from the Village Oaks-Chaucer Court neighborhoods chose Wade Trim for this project.
On October 18, 2010, City Council approved Resolution R-10-365 to award a professional services agreement with Wade Trim for this project in the amount of $54,991.00 and contingency in the amount of $5,500.00 for a total project budget of $60,491.00 for this project.
Amendment No. 1 will increase the total amount of the professional services agreement to $67,991.00. Funding for this amendment will come from the contingency line item ($5,500) in the previously approved project budget and an additional $7,500.00 from the approved Stormwater Capital Budget.
The additional services provided by this amendment are related to the Public Engagement component (Task C) of the study. As part of the Public Outreach and Engagement Strategy, a Technical Advisory Committee (TAC) was formed to guide the project team through the various phases of the project. The TAC members include City Staff, County Officials, and residents within the study area. The additional budget will allow for the completion of the public engagement component, including the efforts associated with the TAC meetings, which is vital for the success and completion of the study.
Wade Trim received Human Rights approval on July 22, 2011 and Living Wage approval on April 29, 2010. All personnel involved with this project will receive a "living" wage.

Whereas, Professional consulting services are needed in the form of engineering for the Village Oaks - Chaucer Court Drainage Area Study;
Whereas, Additional work and efforts to complete the public engagement component of the work, particular items associated with the Technical Advisory Committee, it is necessary to amend the existing professional services agreement with Wade Trim, Inc., for the services associated with the project;
Whereas, Funding for this study is available in the Village Oaks - Chaucer Court Drainage Area Study project budget and the approved Stormwater Capital Budget; and
Whereas, Wade Trim, Inc. received Human Rights approval on July 22, 2011 and Living Wage approval on April 29, 2010;
RESOLVED, That Council approve Amendment No. 1 to the Professional Services Agreement with Wade Trim, Inc. in the amount of $13,000.00 for the Village Oaks - Chaucer Court Drainage Area Study;
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said agreement after approval as to form by the City Attorney and approval as to substance by the Public Services Administrator and the City Administrator; and
RESOLVED, The City Administrator be authorized and directed to take the necessary administrative actions to implement this resolution.
