Memorandum
Attached for your review and approval is a resolution that will approve a Use Agreement for 1501 S. State for the subject project.

In order to facilitate the construction of the E. Stadium Boulevard Bridges it is necessary to occupy the parcel of land located at 1501 S. State Street. The use of this parcel will allow the Contractor to occupy to entire parcel and use it as a construction staging area. Also, staff from our Project Management and Construction Engineering Consultant will also be using the building for the management of the project. The agreement allows the City, its Consultants, and the Contractor to occupy the parcel and use the building for two years beginning on September 1, 2011 and ending on August 20, 2013. A payment of $12,560.00 is due upon execution of the agreement with the remaining balance due on, or before, January 3, 2012.

City Staff has negotiated terms of this Use Agreement with the property owner. The agreement has been drafted by the City Attorney’s Office. Funds for this agreement will come from the approved Street Repair Millage Capital Budget.

Whereas, It is necessary to replace the E. Stadium Boulevard Bridges due to their deteriorated condition; and

Whereas, In order to facilitate the construction of the project it is necessary for the City, its consultants, and the contractor to occupy 1501 S. State Street so that it can be used as a construction staging and work area and as a construction office.

RESOLVED, That the Use Agreement for 1501 S. State Street in the amount of $70,0000.00 be approved by City Council;
