Memorandum
This memorandum and resolution requests approval of Amendment No. 1 to the professional services agreement with Malcolm Pirnie of Michigan, Inc. (Malcolm Pirnie) for the physical security upgrades at the water supply facilities.
The Physical Securities Enhancement project is included as a high priority project for 2011 in the City's approved Capital Improvement Plan.  This project includes video surveillance, access control, wireless communication, programming, and integration at the City of Ann Arbor Water Treatment Plant (WTP) and remote stations.  This project was borne from the results of a Vulnerability Assessment.  The Vulnerability Assessment was mandated by the Department of Homeland Security as part of Homeland Security Presidential Directive 7 (HSPD-7) for Critical Infrastructure.
 
Malcolm Pirnie was selected as the design engineer for the project. Council approved a consulting services agreement for $195,600.00 and contingency in the amount of $20,000.00 in October 2005 for this project.
 
Amendment No. 1 to the professional services agreement with Malcolm Pirnie for a total of $459,457.00 reflects the additional consulting services required to execute all of the changes described below:
·      Additional areas were identified to be included in the scope of work for video surveillance.
 
·      Use of radio communication in place of DSL service for communication of surveillance information to the Water Treatment Plant.
 
·      Addition of structural modifications necessary to install the security features at water system facilities.
 
·      Addition of a prequalification process to assess potential bidders to prevent open dissemination of contract plans and specifications.
 
·      Additional construction phase services to address design modifications.
 
·      Design modifications to make improvements proposed for water system facilities consistent and compatible with those security improvements implemented at other City facilities.
 
·      Addition of Drinking Water Revolving Loan Fund compliance management.
 
·      Addition of resident engineering services to oversee construction.
 
It is recommended that Amendment No. 1 to the professional services agreement in the amount of $459,457.00 be approved.
Malcolm Pirnie has received Human Rights approval on May 1, 2011, and complies with the living wage ordinance.
Funding for this project is included in the water fund approved capital budget.  The project is a fourth quarter FY 2011 Drinking Water Revolving Loan Fund (DWRF) project and will utilize low interest rate loans via DWRF.   This resolution will bring the total value of engineering services with Malcolm Pirnie to $655,057.00.

Whereas, It is necessary to complete the Physical Security Updates at Water Supply Facilities to implement recommendation from the Vulnerability Assessment to protect water system infrastructure;
 
Whereas, This project is included as part of the Drinking Water Revolving Loan Fund application made by the City for a select number of water system projects and was accepted for funding through this program;
Whereas, Funding for this is included in the approved capital budget;
 
Whereas, Malcolm Pirnie of Michigan, Inc., as the design engineer for the Physical Security Upgrades Project, is uniquely qualified to complete the expanded scope of work because of their intimate knowledge this project; and
 
Whereas, Malcolm Pirnie of Michigan, Inc has received Human Rights approval on May 1, 2011, and complies with the Living Wage Ordinance;
 
RESOLVED, That the Amendment No. 1 in the amount of $459,457.00 to the Professional Services Agreement with Malcolm Pirnie of Michigan, Inc. is approved;
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute Amendment No. 1 to the Professional Services Agreement after approval as to substance by the City Administrator and approval as to form by the City Attorney;
 
RESOLVED, That the City make the following declaration for the purpose of complying with the reimbursement rules of Treas. Reg. 1.150-2 pursuant to the Internal Revenue Code of 1986, as amended, that the City reasonably expects to reimburse itself for expenditures for the costs of the Project with proceeds of Bonds; and
 
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
