Attached for your review and approval, please find a resolution to approve a sole source construction contract between the City of Ann Arbor and CLI-Concrete Leveling Inc. (CLI) in the amount of $110,800.00 for the 2024 Sidewalk Repair Project. This is one of three construction contracts for the Sidewalk Repair Program, one each for replacements, lifting, and trimming of sidewalk slabs.

 

The project consists of lifting or leveling existing concrete sidewalk slabs that have settled in approximately 20% of the City in 2024, as part of the 5-year cycle Sidewalk Repair Program to annually perform repair and maintenance of the City’s sidewalk system. The attached maps depict the 2024 designated areas.

 

The 2024 Sidewalk Repair Project is created as a unit price contract with the understanding that the actual quantities will vary, based on assessment of the sidewalks in the spring. The construction is scheduled to begin in April 2024 and continue through November 2024. The 2024 contract is structured to allow for two additional one-year renewals, if agreeable to both parties. The Contractor is required to hold their prices for any subsequent contract renewals.

 

Engineering staff produced project specifications and contract documents and solicited construction proposals for the project through the City’s Procurement Unit. No bids were received on February 14 for RFP-06. The City re-solicited, and no responsive bids were received on February 28 for RFP-13.

 

CLI has successfully completed the repair work in the City of Ann Arbor for the past several years, has historically been the sole bidder, and is able to meet the project requirements. Staff recommends awarding the contract for this project to CLI as a sole source contract.

 

CLI has submitted all required Non-Discrimination, Prevailing Wage, Living Wage, and Conflict of Interest Disclosure forms and complies with the requirements of the City’s Non-Discrimination, Prevailing Wage and Living Wage ordinances.

 

Budget/Fiscal ImpactFunding for the project comes primarily from the Street, Bridge, and Sidewalk Millage and is included in the approved capital budget. Some additional funding from various departmental budgets may also be utilized, depending on the locations at which the work is done.

Whereas, The Annual Sidewalk Repair Program is necessary to maintain or repair pedestrian facilities in the City of Ann Arbor;

 

Whereas, The 2024 Sidewalk Repair Project includes the lifting of sunken sidewalks in approximately 20% of the City;

 

Whereas, The City of Ann Arbor received zero responsive proposals for this work, having solicited twice in February, 2024;

 

Whereas, CLI-Concrete Leveling Inc. has successfully completed the work for the City for several years, and has historically been the sole bidder;

 

Whereas, Staff recommends that City Council approve a construction contract with CLI-Concrete Leveling Inc., as a sole source contract;

 

Whereas, The 2024 contract is structured to allow for two (2) additional one-year renewals, if agreeable to both parties, subject to the terms and conditions in the original contract;

 

Whereas, The Contractor has submitted all required Non-Discrimination, Responsible Bidder, Prevailing Wage, Living Wage, and Conflict of Interest Disclosure forms; and

 

Whereas, Funding for the project is included in the approved Street, Bridge, and Sidewalk Millage capital budget;

 

RESOLVED, That City Council approve a construction contract with CLI-Concrete Leveling Inc. in the amount of $110,800.00 for the 2024 Sidewalk Repair Project;

 

RESOLVED, That a contingency amount of $11,000.00 be established within the Project budget, and that the City Administrator be authorized to approve change orders, not to exceed that amount, in order to satisfactorily complete this project;

 

RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said Contract after approval as to substance by the City Administrator and approval as to form by the City Attorney;

 

RESOLVED, That the City Administrator be authorized to approve the extension of the contract for two additional one-year renewals in years 2025 and 2026, subject to the availability of funding; and

 

RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution including approval of needed Traffic Control Orders, night work authorizations, and other similar administrative approvals to allow the work of the project to proceed without delay.
