Resolution to Approve a Construction Contract with E.T. MacKenzie Company For Public Works On-Call Construction Services in the Amount of $500,000.00 for a Period of Two Years (RFP# 23-55)
Memorandum
Attached for your approval is a resolution to approve a construction contract with E.T. MacKenzie Company for up to $500,000.00 for on-call construction services for two (2) years with an option to extend the contract one (1) additional two (2) year period. This contract is for emergency response work exceeding City capabilities, such as complicated sewer or water main repairs, and for small infrastructure improvement projects that fall below the threshold of Capital Improvement Plan Projects.

RFP# 23-55 was advertised on the City's website and on the Michigan Inter-Governmental Trade Network (MITN) website. One (1) proposal was received and publicly opened on October 10, 2023. A selection committee comprised of Public Works staff reviewed the proposals and determined the proposal from E.T. MacKenzie Company provided value based on the criteria in ORD-21-41, adopted by Council on January 3, 2022:

* Workforce Development (20%)
* Social Equity & Sustainability (20%)
* Schedule of Pricing/Cost (20%)

Therefore, staff recommends awarding the contract to E.T. MacKenzie Company for this project. E.T. MacKenzie Company complies with the City's Non-Discrimination and Living Wage ordinances.

Budget/Fiscal Impact: Funding is available in the approved FY24 Public Services Operation and Maintenance and Capital budgets and will be available in subsequent budgets if approved by Council. Funding will be allocated to the appropriate funding source based on scope of individual tasks performed under this contract.
