Resolution to Approve Amendment No. 2 to the Professional Services Agreement with Black & Veatch Ltd of Michigan to Design the Ultraviolet (UV) Disinfection System Replacement Project at the Water Resource Recovery Facility, RFP 22-22 ($493,969.00 Amendment, $898,798.00 Total Contract)

Your approval is requested for Amendment No. 2 to the Professional Services Agreement with Black & Veatch Ltd of Michigan (B&V) in the amount of $493,969.00 for professional engineering services during the construction of the Ultraviolet (UV) Disinfection System Replacement Project for the City’s Water Resource Recovery Facility (WRRF).
The City of Ann Arbor WRRF currently uses a Trojan UV4000 disinfection system to disinfect the WRRF’s final effluent. The current system has been in service since December 2000 and production of certain parts and maintenance items are being phased out by the manufacturer. In addition, the system has reached the end of its useful life and must be replaced.
On August 4, 2022, Council approved a Professional Services Agreement with B&V to perform the work described in RFP No. 22-22, which included an evaluation of the existing operations, collect additional data and information, propose alternative UV disinfection systems and prepare contract documents for a replacement UV disinfection system based on the selected alternative.
During the preliminary design and UV disinfection equipment selection, it became apparent that we construct an enclosure for the UV disinfection system, which was not included in the original design scope. The existing system is located below a metal canopy and is essentially exposed to the weather. Routine maintenance such as changing a bulb or replacing a ballast must be done despite the inclement weather. The new UV disinfection system will utilize sophisticated features, including touch screen controls, UV sensors, and a mechanical bulb wiping system. By enclosing the new UV disinfection system within a metal structure, we believe that we can increase the longevity of the new equipment and provide the highest level of safety for our employees. On June 5, 2023, Council approved Amendment No. 1 to the B&V professional services agreement for the design of a metal structure to enclose the UV Disinfection System.
The final design including plans and specifications were completed and RFP 23-50 was issued on September 11, 2023. On October 17, 2023, three proposals were received for this work. Commercial Contracting Corporation received the highest score among the proposals reviewed by WRRF Staff. Construction is expected to begin in early Spring of 2024.
As stated in RFP 22-22, City staff requested a proposal from B&V for construction engineering services related to the construction of the UV Disinfection System Replacement Project. WRRF staff reviewed the proposed scope of services, schedule and fee submitted by B&V and determined they are reasonable. WRRF staff is requesting your approval of Amendment No. 2 to the Professional Services Agreement with B&V in the amount of $493,969.00 and a contingency of $40,000.00, to provide professional engineering services during construction of the UV Disinfection System Replacement Project.
B&V complies with the requirements of the City’s Non-Discrimination and Living Wage ordinances.
Budget/Fiscal Impact: The City of Ann Arbor Capital Improvements Plan (CIP) includes the WRRF UV Disinfection Replacement (UT-SN-22-01). Funds to finance this contract are included in the approved Sewage Disposal System Capital Budget.

Whereas, On June 5, 2023, Council approved Amendment No. 1 to the B&V professional services agreement for the design of a metal structure to enclose the UV Disinfection System, in the amount of $97,358.00;
Whereas, B&V submitted a proposal in the amount of $493,969.00 to provide professional engineering services during the construction of the UV Disinfection System Replacement Project;
Whereas, B&V’s proposed fee of $493,969.00 is reasonable to perform this work;
Whereas, B&V complies with the requirements of the City’s Non-Discrimination and Living Wage ordinances; and
Whereas, Funds are available in the Sewage Disposal System Capital Budget;
RESOLVED, That City Council approve Amendment No. 2 to the Professional Services Agreement with Black & Veatch Ltd of Michigan in the amount of $493,969.00 to provide professional engineering services during the construction of the WRRF UV Disinfection System Replacement Project;
RESOLVED, That a contingency amount of $40,000.00 be established to fund any additional necessary services and that the City Administrator be authorized to approve changes that do not exceed the contingency amount;
RESOLVED, That the Mayor and City Clerk be authorized to sign the amendment after approval as to substance by the City Administrator and approval as to form by the City Attorney;
RESOLVED, That the City makes the following declaration for the purposes of complying with the reimbursement rules of Treasury Regulations 1.15-2 pursuant to the Internal Revenue Code of 1986, as amended, that the City reasonably expect to reimburse itself for expenditures for the costs of the Project with proceeds of Bonds; and
RESOLVED, That the City Administrator be authorized to take all necessary actions to implement this resolution.
