Resolution to Approve a Construction Contract with Commercial Contracting Corporation for the Water Resource Recovery Facility Ultraviolet (UV) Disinfection System Replacement Project (RFP No. 23-50, $5,030,600.00)

Attached for your approval is a resolution to approve a construction contract with Commercial Contracting Corporation (CCC), in the amount of $5,030,600.00 for the Water Resource Recovery Facility (WRRF) Ultraviolet (UV) Disinfection System Replacement Project.
The City of Ann Arbor WRRF currently uses a Trojan UV4000 disinfection system to disinfect the WRRF’s final effluent. The current system has been in service since December 2000 and production of certain parts and maintenance items are being phased out by the manufacturer. In addition, the system has reached the end of its useful life and must be replaced.
On August 4, 2022, Council approved a Professional Services Agreement with Black & Veatch (B&V) to evaluate the existing operations, collect additional data and information, propose alternative UV disinfection systems and prepare contract documents for a replacement UV disinfection system based on the selected alternative.
During the preliminary design and UV disinfection equipment selection, it became apparent that we need to construct an enclosure for the UV disinfection system, which was not included in the original design scope. The existing system is located below a metal canopy and is essentially exposed to the weather. Routine maintenance such as changing a bulb or replacing a ballast must be done despite the inclement weather. The new UV disinfection system will utilize sophisticated features, including touch screen controls, UV sensors, and a mechanical bulb wiping system. By enclosing the new UV disinfection system within a metal structure, we believe that we can increase the longevity of the new equipment and provide the highest level of safety for our employees. On June 5, 2023, Council approved Amendment #1 to the B&V professional services agreement for the design of a metal structure to enclose the UV Disinfection System,
Solicitation of Proposals
RFP No. 23-50 was prepared along with project specific plans and contract documents. On October 17, 2023, three proposals were received for this work. A selection committee comprised of WRRF staff reviewed the proposals and determined which respondent was the best value based on the following criteria (as laid out in ORD-21-41, adopted by Council on January 3, 2022):
• Qualifications, Experience & Accountability (20%)
• Workplace Safety (20%)
• Workforce Development (20%)
• Social Equity & Sustainability (20%)
• Schedule of Pricing/Cost (20%)
After reviewing and scoring the proposals, staff ranked the respondents in the following order:
1. Commercial Contracting Corporation
2. Weiss Construction Company, LLC
2. Spence Brothers
The replacement of the UV Disinfection System in vital to plant operations and essential in maintaining our compliance with our NPDES permit.
CCC received the highest score among the proposals reviewed by the selection committee. Staff is requesting your approval of a contract with CCC in the amount of $5,030,600.00 to replace the UV Disinfection System Replacement Project and approve a contingency in the amount of $504,000.00 be approved to fund additional necessary services as approved by the City Administrator.
CCC complies with the City’s Non-Discrimination and Living Wage ordinances.
Budget/Fiscal Impact: The City of Ann Arbor Capital Improvements Plan (CIP) includes the WRRF (formerly Wastewater Treatment Plant) UV Disinfection Replacement (UT-SN-22-01). Funds to finance this contract are included in the approved Sewage Disposal System Capital Budget.

Whereas, Sufficient funds for this contract are included in the approved Sewage Disposal System Capital Budget;
Whereas, CCC complies with the requirements of the City’s Non-Discrimination and Living Wage ordinances;
Whereas, It is appropriate now to enter into a contract with said company for said construction project; and
Whereas, The contract sets forth, among other things, the services to be performed by said company, and the payments to be made by the City therefore, all of which are agreeable to the City;
RESOLVED, That City Council approve a construction contract with Commercial Contracting Corporation in the amount of $5,030,600.00 for the UV Disinfection System Replacement Project (RFP No. 23-50);
RESOLVED, That a contingency amount of $504,000.00 be established to fund any additional necessary services to complete the project, and that the City Administrator be authorized to approve change orders that do not exceed the contingency amount;
RESOLVED, That the Mayor and City Clerk be authorized to sign the agreement after approval as to substance by the City Administrator and approval as to form by the
City Attorney;
RESOLVED, That the City makes the following declaration for the purposes of complying with the reimbursement rules of Treasury Regulations 1.15-2 pursuant to the Internal Revenue Code of 1986, as amended, that the City reasonably expect to reimburse itself for expenditures for the costs of the Project with proceeds of Bonds; and
RESOLVED, That the City Administrator be authorized to take all necessary actions to implement this resolution.
