Memorandum

This resolution seeks Council approval for a grant subcontract with the Michigan Supreme Court State Court Administrative Office (SCAO) as it is administering the Michigan Office of Highway Safety Planning Grant Program (“SCAO OHSP Grant Program”).  The resolution further seeks authorization to accept and appropriate the grant award in the amount of $99,000.00, which will be used to fund the 15th Judicial District Court Sobriety Court program (“Grant Award"). 

 

Budget/Fiscal Impact: No matching funds are required for acceptance of this grant award. This grant shall be appropriated to the Major Grants Programs Fund upon acceptance.

 

The 15th Judicial District Court Sobriety Court program is a problem-solving court that focuses on breaking the cycle of drug and/or alcohol addiction that results in criminal activity. The target population consists primarily of repeat offenders convicted of driving while under the influence of alcohol or controlled substances. As space permits, the Court also admits persons convicted of other crimes when there is a strong correlation between the crime and substance abuse. Eligible defendants are diverted into judicially supervised, community-based treatment to address the underlying problems. Participants are also linked with ancillary services such as education, housing, job skills or other individualized assistance. The program provides much needed treatment to participants while also helping the community by reducing jail time, recidivism rates, and court docket congestion.

 

Approval and appropriation of a ten percent (10%) contingency in the amount of $9,900.00 is also requested to allow the Court to increase services should additional funds become available through an approved State Court Administrative Office grant program budget amendment.

Whereas, The Michigan Supreme Court State Court Administrative Office (SCAO) invited an application from the 15th Judicial District Court for Michigan Office of Highway Safety Grant Program funds to continue the operations of a specialized Sobriety Court;

 

Whereas, The 15th Judicial District Court applied for and was awarded $99,000.00 by SCAO pursuant to that invitation; and

 

Whereas, It is in the best interests of the City of Ann Arbor and in the best interests of justice to enter into a grant subcontract with SCAO and to accept and allocate grant funds awarded by SCAO for this purpose;

 

RESOLVED, That City Council approve the Subcontract Grant Agreement with the State Court Administrative Office and accept the Grant Award of $99,000.00 from the SCAO OHSP Grant Program to the 15th Judicial District Court;

 

RESOLVED, That City Council appropriate $99,000.00 to the FY24 expenditure budget of the District Court within the Major Grants Programs Fund with the source of revenue being the Grant Award from the SCAO, administrator of the SCAO OHSP Grant Program;

 

RESOLVED, That City Council approve a ten percent (10%) contingency should additional funds become available through an approved SCAO OHSP Grant Program Amendment with the approval of the SCAO and the City Administrator;

 

RESOLVED, That City Council appropriate up to a ten percent (10%) contingency in the amount of $9,900.00 to the FY24 expenditure budget of the District Court within the Major Grants Programs Fund with the source of revenue being the Grant Award from the SCAO, administrator of the SCAO OHSP Grant Program;

 

RESOLVED, That all amounts herein may be expended without regard to fiscal year;

 

RESOLVED, That the Mayor and City Clerk be authorized and directed to execute the Subcontract Grant Agreement with the State Court Administrative Office on behalf of the Court and the City following approval as to form by the City Attorney and as to substance by the City Administrator; and

 

RESOLVED, That City Council authorize the Court Administrator to take all necessary administrative actions to implement this resolution including acting as the Authorizing Official for SCAO purposes.
