Resolution to Approve a Two (2) Year Construction Contract with Saladino Construction Co., Inc. for As-Needed Miscellaneous Concrete Repairs RFP 23-45 (up to $358,452.00 over two years)

Memorandum

Attached for your approval is a resolution authorizing a two (2) year construction contract with Saladino Construction Co., Inc. for up to $358,452.00 for as-needed miscellaneous concrete repairs.

 

RFP 23-45 was advertised on the City’s Website and on the Michigan Inter-governmental Trade Network (MITN) website. Two (2) bids were received and publicly opened on August 29, 2023.  A selection committee comprised of Public Services staff reviewed the proposals and determined which bidder was the Best Value based on the criteria in ORD-21-41:

 

                     Qualifications, Experience, & Accountability (20%)

                     Workplace Safety (20%)

                     Workforce Development (20%)

                     Social Equity & Sustainability (20%)

                     Schedule of Pricing/Cost (20%)

 

After reviewing and scoring the proposals, staff ranked the responding firms in the following order:

 

1.                     Saladino Construction Co., Inc.

2.                     Doan Construction Company

 

Saladino Construction Co., Inc. received the highest score among the proposals reviewed by the selection committee. Therefore, staff recommends approving a contract with Saladino Construction Co., Inc. for this project.

 

Saladino Construction Co., Inc. complies with the City’s Non-Discrimination and Living Wage ordinances.

 

Budget/Fiscal Impact:  Funding is available in the various approved FY24 Operation and Maintenance and Capital budgets within Public Service Area and Parks Maintenance and Capital Improvements Millage.  Funding is anticipated to be available in future fiscal years, if so approved by City Council. As tasks are performed, the associated costs will be charged to the appropriate funding sources.

Whereas, Public Works would like to enter into a two-year construction contract for as-needed miscellaneous concrete repairs;

 

Whereas, The City of Ann Arbor received two proposals for this work on August 29, 2023 and Saladino Construction Co., Inc. received the highest score among the proposals reviewed by the selection committee;

 

Whereas, Funding is available in the approved FY24 Operation and Maintenance and Capital budgets within Public Service Area and Parks Maintenance and Capital Improvements Millage. Funding is anticipated to be available in future fiscal years, if so approved by City Council and will be allocated based on the actual scope of the project;

 

Whereas, Unforeseen needs may arise requiring additional as-needed concrete replacement;

 

Whereas, The term of the proposed contract with Saladino Construction Co., Inc. is for two years and up to $358,452.00, subject to the availability of funding, and the parties may mutually agree to extend the contract for one two-year period with a rate adjustment not to exceed 5% subject to annual appropriations and availability of funds; and

 

Whereas, Saladino Construction Co., Inc. complies with the City’s Non-Discrimination and Living Wage Ordinances;

 

RESOLVED, That City Council approve a two-year construction contract with Saladino Construction Co., Inc. in the amount not to exceed $358,452.00 for as-needed miscellaneous concrete repairs (RFP 23-45), subject to the annual appropriation of funds;

 

RESOLVED, That continuation of this contract after the first year is subject to the availability of funding in the approved budget;

 

RESOLVED, That a 10% contingency in the amount of $35,845.20 be established within the contract budget and that the City Administrator be authorized to approve construction change orders for additional needed concrete repairs not to exceed that amount;

 

RESOLVED, That the City Administrator be authorized to extend the agreement for up to one, two-year period with a one-time cost increase of no greater than 5% may be added to the submitted rates and subject to the annual appropriation of funds and the parties’ mutual agreement on the terms of the extension;

 

RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said agreement after approval as to substance by the City Administrator and approval as to form by the City Attorney; and

 

RESOLVED, That the City Administrator be authorized to take necessary administrative actions to implement this resolution, including issuing temporary and permanent Traffic Control Orders and night work authorizations as required for the construction of the project.
