Resolution to Approve a Construction Contract with Anlaan Corporation for the Gallup Park Vehicle and Pedestrian Bridge Project and Appropriate Funding ($4,184,015.40) (8 Votes Required)

Memorandum

Attached for your review and action is a resolution to approve a construction contract with Anlaan Corporation in the amount of $4,184,015.40 for the Gallup Park Vehicle and Pedestrian Bridge project which will entail demolition of the existing bridge and construction of a new replacement bridge.

 

Project Description:  The Parks and Recreation Open Space Plan identifies bridge repair as an on-going need and one of the major categories of capital project improvements.

 

The bridge was constructed in 1976 and has reached the end of its useful life.  A 2018 inspection identified the need to “begin the process of investigating the replacement of this structure, including design, funding sources, etc., as the life expectancy of this structure has been reached, if not exceeded.”

 

In 2020, repairs were made to the bridge to extend its use until a replacement could be constructed.  Additionally, the City engaged the community to provide input on the design for the bridge’s replacement, as well as long-term plans for redeveloping the adjacent road and trail.  The City hired the team of Wade Trim and Associates, Inc. and SmithGroup, Inc. to lead the community engagement and concept plan design, which resulted in a recommended bridge design concept and a schematic master plan for the surrounding area.

 

In 2022, the City contracted with the same design team to provide detailed design engineering for the new replacement bridge, as well as road and trail improvements in the immediate area.  This scope of work included the preparation of the construction plans, specifications and estimates that the City used to bid this work for construction.

 

Additionally, in 2022 a survey of threatened and endangered mussels was conducted in the area of impact in the Huron River.  While no federally-listed species were identified, state-listed species were found at the site and they were relocated to a new site in the summer of 2023 prior to the start of construction. 

 

Solicitation of Bids:  The City Administrator approved an exemption to best value procurement for this contract in compliance with Best Value Procurement APP 209 due to the use of federal funds, which require that the lowest responsible bidders be used for all sealed bids and requests for proposals for City projects receiving ARPA funds. 

 

Park staff solicited bids through Invitation to Bid #4736 through the City’s Procurement Unit. Project plans and specifications were distributed electronically to contractors, subcontractors, and suppliers through the City of Ann Arbor’s procurement website and MITN.info.  Two options (A & B) were bid for required bank stabilization stone, with option ‘A’ providing ledgestone that is preferred for river access.

 

On August 25, 2024, five bids were received and opened. The lowest responsible bid, from Anlaan Corporation, in the amount of $4,184,015.40 for the combined base bid and option ‘A’, which was 6.8% below the Engineer’s Estimate. Attached is a summary of the bids received for the project.

 

Anlaan Corporation is a prequalified contractor with MDOT under Section Fa; Bridges and Specialty Structures and has successfully completed bridge repair work for the City of Ann Arbor in the past.  Anlaan Corporation is able to meet the project requirements and has submitted all required Non-Discrimination, Prevailing Wage, Living Wage, and Conflict of Interest Disclosure forms and complies with the requirements of the City’s Non-Discrimination and Living Wage ordinances.

 

Therefore, Staff recommends that City Council approve a construction contract with Anlaan Corporation in the amount of $4,184,015.40 for construction of the Gallup Park vehicle and pedestrian bridge with option ‘A’. A 10% construction contingency of $418,401.54 is requested to cover potential contract change orders to be approved by the City Administrator.  It is requested that a $4,602,416.94 contract and contingency amount be approved for the life of the project without regard to fiscal year.

 

The Park Advisory Commission unanimously recommended approval of this contract at their September 19, 2024 meeting.

 

Budget/Fiscal Impact:  Funding is available from the federal American Rescue Plan Act (ARPA) funds that were allocated to this project. City Council approved resolution R-22-096 to direct the allocation of ARPA funds, which allocated $2,300,000.00 toward the Gallup bridge project to be used for both design and construction of the project.  $404,979.98 in ARPA funds have been expended for design and grant reporting for the project, leaving $1,895,020.00 available for construction.  It is being requested that $2,288,995.00 be appropriated to the FY2024 Park Maintenance and Capital Improvement Millage from fund balance for remaining portion of the project.

RESOLVED, That City Council approve a construction contract with Anlaan Corporation in the amount of $4,184,015.40 for the Gallup Park vehicle and pedestrian bridge project (ITB 4736);

 

RESOLVED, That a contingency amount of $418,401.54 (10%) be established within the project to cover potential contract change orders for the life of the project without regard to fiscal year and that the City Administrator be authorized to approve additional change orders to the construction contract with Anlaan Corporation not to exceed the contingency amount in order to satisfactorily complete this project;

 

RESOLVED, That $2,288,995.00 be appropriated from the fund balance of the Park Maintenance and Capital Improvement Millage to the Parks and Recreation FY2024 Park Maintenance and Capital Improvement Millage expenditure budget for the purpose of the Gallup Park vehicle and pedestrian bridge project;

 

RESOLVED, That $418,402.00 be appropriated from the fund balance of the Park Maintenance and Capital Improvement Millage to the Parks and Recreation FY2024 Park Maintenance and Capital Improvement Millage expenditure budget for the purpose of the Gallup Park vehicle and pedestrian bridge project as a project contingency, subject to City Administrator approval;

 

RESOLVED, That all amounts herein are without regard to fiscal year;

 

RESOLVED, That the Mayor and City Clerk are authorized and directed to execute the contract after approval as to substance by the City Administrator and approval as to form by the City Attorney; and

 

RESOLVED, That the City Administrator be authorized to take necessary administrative actions to implement this resolution, including issuing temporary and permanent Traffic Control Orders and night work authorizations as required for the construction of the project.
