An Ordinance to Amend Section 7:602, Sections 7:604 to 7:606, Section 7:608 and Section 7:613 of Chapter 96 (Medical Marijuana Facilities and Marijuana Establishments) of Title VII of the Code of the City of Ann Arbor (ORD-23-28)

Since the adoption of the original Medical Marijuana Facilities ordinance in 2017, ordinance revisions have been adopted to reflect the expansion of the medical and adult use marijuana industry in Michigan to include additional license types, and to streamline the City's marijuana facility permit application process. Adoption of the attached ordinance will keep our ordinance in line with changes in State law and simplify the application process for applicants and the administrative procedures.
In 2022 the State of Michigan created a new license type, Microbusiness Class A. Adding this license type to the ordinance will allow businesses to apply for this new classification of Microbusiness license in the City of Ann Arbor. The total number of Microbusiness Special Exception Use permits will remain 28. Currently, there is one Microbusiness licensed and operating in Ann Arbor.
To simplify the marijuana facility permit application process as well as the administrative procedures, this ordinance amendment clarifies terms, extends the reapplication timeline, and clarifies the circumstances in which a reapplication is required. Instructions for businesses in receivership were added to provide for clear communication with the City in these cases.
Finally, there has been interest among marijuana business owners to allow extended hours of operation. After discussion with AAPD, we recommend amending the ordinance to allow operating hours as late as 12:00 a.m., from the current 9:00 p.m. limit. Changes have been reviewed by Planning and Zoning and they have approved the proposed amendments.
