Resolution to Approve a Construction Contract with Bailey Excavating, Inc for the Pontiac, Swift, Moore and Wright Watermain and Resurfacing Project ($2,759,293.42) and to Appropriate $2,316,000.00 in Contributing Funds (8 Votes Required) 

Memorandum

Attached for your review and approval, please find a resolution to approve a construction contract between the City of Ann Arbor and Bailey Excavating, Inc in the amount of $2,759,293.42 for the Pontiac, Swift, Moore and Wright Watermain and Resurfacing Project (RFP 23-22).

 

Pontiac, Swift, Moore and Wright Watermain and Resurfacing Project limits consist of Pontiac Trail (Moore to Swift), Swift Street (Wright to Broadway), the intersection of Broadway and Swift, Moore Street (Broadway to Pontiac Trail), Wright Street (dead-end to Kellogg), and Wright Street (Longshore to Swift). See attached map.

 

The project includes the following elements and (funding sources):

                     Replacement of water main and related appurtenances and selected water main consolidation (Water Supply System Fund)

                     Selected stormwater system improvements (Stormwater Fund)

                     Road resurfacing, intermittent curb replacements, selected bump-out additions, and sidewalk and ramp replacements (Street, Bridge, and Sidewalk Millage Fund)

                     Buffered bike lanes on Pontiac and Moore.

                     Minor sanitary sewer improvements (Sewage Disposal System Fund)

 

The construction of the project is scheduled in three phases in 2023:

                     Phase 1: Early-July to Mid-August 2023; work on Pontiac Trail (Moore to Swift), Swift Street (Wright to Broadway), and the intersection of Broadway and Swift.

                     Phase 2: Mid-August to Mid-September 2023; work on Wright Street (dead-end to Kellogg), Wright Street (Longshore to Swift), and finish Swift Street (Wright to Pontiac Trail).

                     Phase 3: Mid-September to Mid-October 2023; work on Moore Street (Broadway to Pontiac Trail).

 

Engineering staff supervised the creation of plans and contract documents and bid the project through the City’s Procurement Unit. On April 26, 2023, two proposals were received for this work. A selection committee comprised of Public Services staff reviewed the proposals and determined the proposal from Bailey Excavating, Inc. provided the best value based on the criteria provided in ORD-21-41, adopted by Council on January 3, 2022:

Therefore, staff recommends awarding the contract for this project to Bailey Excavating, Inc. Bailey Excavating complies with the City’s Non-Discrimination and Living Wage ordinances.

 

Budget/Fiscal Impact:  This project is included in the FY24-29 Capital Improvements Plan (TR-SC-16-14 and UT-WS-16-10). The estimated total cost of the project is $3,867,082. Funding for the project is included in the approved capital budgets of the Water Supply System, Sewage Disposal System, Stormwater, and the Street, Bridge and Sidewalk Millage Funds and the Water Supply System Fund Balance.

Whereas, The existing water mains along Pontiac, Swift, Moore and Wright are in poor condition, undersized and are in need of replacement or consolidation;

 

Whereas, The pavement at these locations is in poor condition and in need of replacement;

 

Whereas, The addition of selected bump-outs, improved sidewalk ramps, and buffered bike lanes are important for maintaining safe and accessible active transportation facilities in the area;

 

Whereas, Funding for the project is available in the Water Supply System, Stormwater, Sewage Disposal System, and Street, Bridge and Sidewalk Millage Funds;

 

Whereas, The City of Ann Arbor received two proposals for this work on April 26, 2023, and after review staff recommends award of the construction contract to Bailey Excavating, Inc.; and

 

Whereas, It is now necessary to enter into a contract with Bailey Excavating, Inc. for the performance of this work;

 

RESOLVED, That City Council approves a construction contract with Bailey Excavating, Inc. in the amount of $2,759,293.42 for the Pontiac, Swift, Moore and Wright Watermain and Resurfacing Project (RFP 23-22);

 

RESOLVED, That $600,000.00 be appropriated from the Water Supply System Fund unobligated fund balance to the Pontiac, Swift, Moore and Wright Watermain and Resurfacing Project; thereby increasing the project revenue and expenditure budgets;

 

RESOLVED, That $1,640,000.00 be appropriated from the Street, Bridge, Sidewalk Millage Fund Capital Budget to the Pontiac, Swift, Moore and Wright Watermain and Resurfacing Project; thereby increasing the project revenue and expenditure budgets;

 

RESOLVED, That $60,000.00 be appropriated from the approved Stormwater Fund Capital Budget to the Pontiac, Swift, Moore and Wright Watermain and Resurfacing Project; thereby increasing the project revenue and expenditure budgets;

 

RESOLVED, That $16,000.00 be appropriated from the approved Sewage Disposal System Fund Capital Budget to the Pontiac, Swift, Moore and Wright Watermain and Resurfacing Project; thereby increasing the project revenue and expenditure budgets;

 

RESOLVED, That a contingency amount of $276,000.00 be established within the project budget and that the City Administrator be authorized to approve construction change orders not to exceed that amount, in order to satisfactorily complete this project;

 

RESOLVED, That the City make the following declaration for the purpose of complying with the reimbursement rules of Treasury Regulations 1.150-2 pursuant to the Internal Revenue Code of 1986, as amended: that the City reasonably expects to reimburse itself for expenditures for the costs of the Project with proceeds of Bonds;

 

RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said agreement after approval as to substance by the City Administrator and approval as to form by the City Attorney; and

 

RESOLVED, That the City Administrator be authorized to take necessary administrative actions to implement this resolution, including issuing temporary and permanent Traffic Control Orders and night work authorizations as required for the construction of the project.
