Resolution to Approve Amendment No. 1 to the Professional Services Agreement with Black & Veatch Ltd. of Michigan to Design the Ultraviolet (UV) Disinfection System Replacement Project at the Wastewater Treatment Plant, RFP 22-22 ($97,358.00 Amendment, Total Contract $404,829.00)

Your approval is requested for Amendment No. 1 to the Professional Services Agreement with Black & Veatch Ltd. of Michigan (B&V) in the amount of $97,358.00 for professional engineering services to design the Ultraviolet (UV) Disinfection System Replacement Project for the City’s Wastewater Treatment Plant (WWTP).
The City of Ann Arbor WWTP currently uses a Trojan UV4000 disinfection system to disinfect the WWTP’s final effluent. The current system has been in service since December 2000 and production of certain parts and maintenance items are being phased out by the manufacturer. In addition, the system has reached the end of its useful life and must be replaced.
On August 4, 2022, Council approved a Professional Services Agreement with B&V to perform the work described in RFP No. 22-22, which included an evaluation of the existing operations, collect additional data and information, propose alternative UV disinfection systems and prepare contract documents for a replacement UV disinfection system based on the selected alternative.
During the preliminary design and UV disinfection equipment selection, it became apparent that we should construct an enclosure for the new UV disinfection system, which was not included in the original design scope. The existing system is located below a metal canopy and is essentially exposed to the weather. Routine maintenance such as changing a bulb or replacing a ballast must be done despite the inclement weather. The new UV disinfection system will utilize sophisticated features, including touch screen controls, UV sensors, and a mechanical bulb wiping system. By enclosing the new UV disinfection system within a metal structure, we believe that we can increase the longevity of the new equipment and provide the highest level of safety for our employees.
In addition to the original contract amount of $307,471.00, Council approved a contingency of $31,000.00. B&V submitted a proposal for the design change that will result in an increase of $97,358.00, minus the original contingency resulting in an increase of $66,358.00 to the original approved amount.
The final design including plans and specifications are expected to be completed by July 2023 and the construction bid advertised by August of 2023. Construction is expected to begin in late October 2023.
WWTP staff is requesting your approval of Amendment 1 to the Professional Services Agreement with B&V in the amount of $97,358.00 and to reestablish a design contingency of $40,000.00, to provide professional engineering services for the design of a metal enclosure for the new UV Disinfection System.
B&V complies with the requirements of the City’s Non-Discrimination and Living Wage ordinances.
Budget & Fiscal Impact: The City of Ann Arbor Capital Improvements Plan (CIP) includes the WWTP UV Disinfection Replacement (UT-SN-22-01). Total estimated project costs are $3,410,000.00.

Whereas, WWTP staff request that Council approve a new design contingency of $40,000.00 to fund additional necessary services as approved by the City Administrator;
Whereas, Black & Veatch Ltd. of Michigan complies with the requirements of the City’s Non-Discrimination and Living Wage ordinances; and
Whereas, Funds are available in the Sewage Disposal System Capital Budget;
RESOLVED, That City Council approve Amendment No. 1 to the Professional Services Agreement with Black & Veatch Ltd. of Michigan in the amount of $97,358.00 to provide professional engineering services to design the metal enclosure for the WWTP UV Disinfection System Replacement Project;
RESOLVED, That Council approve a new contingency of $40,000.00 to fund additional necessary services as approved by the City Administrator;
RESOLVED, That the Mayor and City Clerk be authorized to sign the agreement after approval as to substance by the City Administrator and approval as to form by the City Attorney; and
RESOLVED, That the City Administrator be authorized to take all necessary actions to implement this resolution.
