Resolution to Approve a Construction Contract with Doan Construction Co. for the Sanitary Manhole Raising Project ($1,479,493.00) 

Memorandum

Attached for your review and approval is a resolution to approve a construction contract between the City of Ann Arbor and Doan Construction Co. in the amount of $1,479,493.00 for the Sanitary Manhole Raising Project (RFP 22-74).

 

The purpose of this project is to locate, expose and raise approximately 190 sanitary manholes to grade, both under and outside of the road pavement, to allow access to inspect and maintain the sanitary sewer system. 

 

As a result of previous sanitary sewer overflows, the City entered into an Administrative Consent Order (ACO) with The Michigan Department of Environment, Great Lakes, and Energy (EGLE). A part of the ACO, the City is required to perform an evaluation of the portion of the sewage collection system that the City had not evaluated in the last six years (Evaluation Plan).  The Evaluation Plan includes the identification of sewage collection system impairments that have caused or are likely to cause blockages, breaks or overflows of sewage.  To complete our investigation and appropriately assess the condition of the sanitary sewer manholes and ensure compliance with the ACO, the City needs to raise manholes that are not currently accessible.

 

In response to RFP 22-74, two (2) proposals were received on November 15, 2022. A selection committee comprised of Public Works staff reviewed the proposals and determined which proposal was the best value based on the criteria provided in ORD-21-41, adopted by Council on January 3, 2022:

After reviewing and scoring the proposals, staff ranked the responding firms in the following order:

 

1.                     Doan Construction Co.

2.                     E.T. MacKenzie Company

 

Doan Construction Co. received the highest score among the proposals reviewed by the selection committee. Therefore, staff recommends awarding the contract for this project to Doan Construction Co.

 

Doan Construction Co. complies with the City’s Non-Discrimination and Living Wage ordinances.

 

Budget/Fiscal Impact:  This project is included in FY2024-29 Capital Improvements Plan (UT-SN-22-09). Funding for the project is included in the approved FY23 capital budget of the Sewage Disposal System Fund, additional funding will be available for future fiscal years if so, approved by Council.

Whereas, The City must raise buried sanitary manholes in order to access, inspect and maintain the sanitary sewer system;

 

Whereas, Public Works published RFP 22-74 and two proposals were received and publicly opened on November 15, 2022;

 

Whereas, Doan Construction Co. provided a qualified proposal that met the City’s project specifications and received the highest score among the proposals reviewed by the selection committee;

 

Whereas, Doan Construction Co. complies with the City’s Non-Discrimination and Living Wage ordinances;

 

Whereas, Funding for the project is included in the approved capital budget of the Sewage Disposal System Fund; and

 

Whereas, It is now necessary to enter into a contract with Doan Construction Co. for the performance of this work;

 

RESOLVED, That City Council approves a construction contract with Doan Construction Co. in the amount of $1,479,493.00 for the Sanitary Manhole Raising Project (RFP 22-74);

 

RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said agreement after approval as to substance by the City Administrator and approval as to form by the City Attorney;

 

RESOLVED, That the City make the following declaration for the purpose of complying with the reimbursement rules of Treasury Regulations 1.150-2 pursuant to the Internal Revenue Code of 1986, as amended: that the City reasonably expects to reimburse itself for expenditures for the costs of the Project with proceeds of Bonds; and

 

RESOLVED, That the City Administrator be authorized to take necessary administrative actions to implement this resolution, including issuing temporary and permanent Traffic Control Orders and night work authorizations as required for the construction of the project.
