Attached for your review and approval, please find a resolution to approve a construction contract between the City of Ann Arbor and Bailey Excavating, Inc. in the amount of $5,742,710.73 for the South Main Street Water Main Replacement and Resurfacing Project (RFP 22-82).
The South Main Street Water Main Replacement and Resurfacing Project, from E. William St. to E. Huron St. includes the following elements and (funding sources):
• Replacement of water main and related appurtenances (Water Supply System Funds)
• Selected stormwater system improvements (Stormwater Funds)
• Road resurfacing, intermittent curb replacements, selected bump-out additions, sidewalk and ramp replacements, and APS-ready pedestrian signal improvements (Street, Bridge, and Sidewalk Millage Funds)
• Sanitary sewer extension and repairs (Sanitary Sewer Funds)
• Sanitary service to connect 353 South Main Street Project (Ann Arbor Housing Commission (AAHC) Funds)
• Irrigation meter pits and related improvements (DDA Funds)
It should be noted that this project is primarily focused on the underground infrastructure and pavement condition. No substantial reconfiguration of the roadway is suggested at this time. The reason for this is that the project was scoped and budgeted several years ago - prior to the adoption of the “Moving Together Towards Vision Zero” Transportation Master Plan. The Moving Together Plan identifies Main Street as part of the All Ages and Abilities Bicycle Network which would imply installation of some sort of protected bike facility. However, some notable tradeoffs would have to be made to accommodate an All Ages and Abilities Bicycle facility given the road width and activity along this section of Main Street (e.g. removal of on street parking, landscaped bumpouts, and/or travel lanes).
Staff would like to give assurance that Main Street and its role in the transportation network will be looked at as part of a downtown circulation study which will occur later this year and will be a joint initiative of the DDA and the City. This is an important study which will help chart a cohesive transportation vision for downtown and will build on existing studies and plans (the Moving Together Plan, The Ride’s 2045 Long Range Plan, the DDA’s People Friendly Streets initiative and downtown street design guidelines, etc.). It is intended to assess which streets will be best suited for vehicular, transit, pedestrian, and cyclist movements and how those roads can be configured to best accommodate those movements. The current construction project will not prevent such changes from being implemented in the future following this study.
The construction of the project is scheduled in three stages over in 2023:
• Stage 1: February-May, 2023; all work from William St. to Liberty St.
• Stage 2: May-July, 2023; all work from Liberty St. to Huron St.
• Stage 3: July-August, 2023; sewer work at Huron & South Main intersection.
Work will be shut down for the week of Art Fairs, and all road and pedestrian areas opened to Art Fair operations. Other special events typically occurring on Main Street will be temporarily relocated.
Engineering staff supervised the creation of plans and contract documents and bid the project through the City’s Procurement Unit. On December 20, 2022, one proposal from Bailey Excavating, Inc. was received for this work. A selection committee comprised of Public Services staff reviewed the proposal and determined the proposal from Bailey Excavating, Inc. provided value based on the criteria provided in ORD-21-41, adopted by Council on January 3, 2022:

Therefore, staff recommends awarding the contract for this project to Bailey Excavating, Inc. Bailey Excavating, Inc. complies with the City’s Non-Discrimination and Living Wage ordinances.
Budget/Fiscal Impact: This project is included in the FY23-28 Capital Improvements Plan (TR-SC-16-11 and UT-WS-16-33). The estimated total cost of the project is $8,040,000. Funding for the project is included in the approved capital budgets of the Water Supply System, Sanitary Sewer, Stormwater, and the Street, Bridge and Sidewalk Millage Fund.

Whereas, The existing water mains along South Main Street are in poor condition and undersized, and are in need of replacement;
Whereas, The pavement on South Main Street is in poor condition and in need of replacement;
Whereas, The addition of selected bump-outs, improved sidewalk ramps, and APS-ready facilities are important for maintaining safe and accessible pedestrian facilities in the area;
Whereas, Funding for the project is available in the Water Supply System, Stormwater, Sanitary Sewer Funds, and Street, Bridge and Sidewalk Millage;
Whereas, The Ann Arbor Housing Commission will contribute funds for the sanitary service connection for their 353 South Main Street Project;
Whereas, The Downtown Development Authority will contribute funds for the irrigation meter pits and related improvements;
Whereas, The City of Ann Arbor received one proposal for this work on December 20, 2022 from the Bailey Excavating, Inc., and after review, staff recommends award of the construction contract to Bailey Excavating, Inc.; and
Whereas, It is now necessary to enter into a contract with Bailey Excavating, Inc. for the performance of this work;
RESOLVED, That City Council approves a construction contract with Bailey Excavating, Inc. in the amount of $5,742,710.73 for the South Main Street Water Main Replacement and Resurfacing Project (RFP 22-82);
RESOLVED, That a contingency amount of $575,000.00 be established within the project budget and that the City Administrator be authorized to approve construction change orders not to exceed that amount, in order to satisfactorily complete this project;
RESOLVED, That the South Main Street Water Main Replacement and Resurfacing Project expenditure and revenue budgets be increased by $3,438,000.00 with the sources of funding being the appropriation of $2,811,000.00 from the Street, Bridge, Sidewalk Millage Fund, $436,000.00 from the Stormwater Fund, $46,000.00 from the Sewage Disposal Fund, $44,000.00 in AAHC Funding, and $119,000.00 of funding from the Downtown Development Authority;
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said agreement after approval as to substance by the City Administrator and approval as to form by the City Attorney;
RESOLVED, That the City make the following declaration for the purpose of complying with the reimbursement rules of Treasury Regulations 1.150-2 pursuant to the Internal Revenue Code of 1986, as amended: that the City reasonably expects to reimburse itself for expenditures for the costs of the Project with proceeds of Bonds; and
RESOLVED, That the City Administrator be authorized to take necessary administrative actions to implement this resolution, including issuing temporary and permanent Traffic Control Orders and night work authorizations as required for the construction of the project.
