Resolution to Accept an Amended Grant of Easement for 40 Foot Watermain from Maple Center Investments LLC at Maple Center Condominium (8 Votes Required)

Memorandum

This easement is granted in conjunction with the Lewis Jeweler Site Plan approved by Council on March 15, 2021, R-21-096. A separate easement was recorded on August 23, 2022 in Liber 5495, page 779, Washtenaw County Records. This easement was not accepted by Council and the amended grant of easement being approved in this resolution will supersede and replace that easement.

 

The easement is in standard form and is conveyed without cost to the City.

 

Acceptance of this easement is recommended.

Body

Whereas, Maple Center Investments, LLC, a Michigan limited liability company (“Grantor”) is the developer of property commonly known as Maple Center Condominium, Ann Arbor, Michigan 48103; and

 

Whereas, Grantor has signed an amended grant of easement for 40 foot watermain and appurtenances as described below and on the attached map:

 

A 40.00 foot wide Watermain Easement located in part of the Northeast one-quarter of Section 25, Town 2 South, Range 5 East, City of Ann Arbor, Washtenaw County, Michigan, being further described as follows:

 

Commencing at the East One-Quarter Corner of Section 25; thence South 88 degrees 21 minutes 54 seconds West 33.00 feet along the East-West One-Quarter line of Section 25 to a point on the West Right-of-Way line of S. Maple Road (66 feet wide); thence North 01 degree 55 minutes 48 seconds West 230.28 feet along said West Right-of-Way line of S. Maple Road (66 feet wide) to the Point of Beginning; thence South 87 degrees 54 minutes 36 seconds West 40.00 feet; thence North 01 degree 55 minutes 48 seconds West 40.52 feet; thence North 88 degrees 03 minutes 53 seconds East 40.00 feet to said West Right-of-Way line of S. Maple Road (66 feet wide); thence South 01 degree 55 minutes 48 seconds East 40.42 feet along said West Right-of-Way line of S. Maple Road (66 feet wide) to the Point of Beginning.

 

RESOLVED, That the Mayor and Clerk be authorized and directed to execute the Amended Grant of Easement to supersede and replace the easement recorded in Liber 5494, page 779, Washtenaw County Records; and

 

RESOLVED, That the City of Ann Arbor hereby accepts this Amended Grant of Easement.
