Resolution to Accept Sanitary and Water Easements and Approve an Easement Agreement at Maple Village Condominium (8 Votes Required)

Memorandum

These easements are granted in conjunction with the Maple Cove Apartments and Village Site Plan approved by Council on May 1, 2012, R-12-175. An easement agreement is also necessary to address building encroachments in Unit 1 of the condominium.

Body

Whereas, Maple Village Homeowners Association, a Michigan nonprofit corporation, Mustafa Mehrabi, Jon Choate and Carol Choate, and Maple Cove of Ann Arbor, LLC, a Michigan limited liability company (“Grantors”) are the interested parties in property commonly known Maple Village Condominium, Ann Arbor, Michigan 48103;

 

Whereas, Grantors have signed grants of easement for sanitary sewer and water main and appurtenances as illustrated and described on the attached maps; and

 

Whereas, Maple Village Homeowners Association and Mustafa Mehrabi have signed an easement agreement addressing a building encroachment in Unit 1 of the condominium;

 

RESOLVED, That the City of Ann Arbor hereby accepts these grants of easement and approves the easement agreement; and

 

RESOLVED, That the Mayor and City Clerk are authorized and directed to sign the easement agreement.
