Resolution to Approve a Construction Contract with Insituform Technologies USA, LLC for the High Level Trunkline Sanitary Sewer Rehabilitation Phase 2 Project ($4,242,055.60)

Memorandum

Attached for your review and approval, please find a resolution that awards a construction contract to Insituform Technologies USA, LLC for the High Level Trunkline Sanitary Sewer Rehabilitation Phase 2 Project (RFP 22-70).

 

This project consists of lining approximately 4,300 feet of 30-inch sanitary sewer and 1,980 feet of 15-inch sanitary sewer beginning at Jefferson Street near Ashley Street and extending northwest along the railroad right-of-way to First Street then north along First Street, terminating at Miller Avenue. An additional section of lining will also occur starting at Hoover Avenue near Division and extend east along Hoover Avenue, south along State Street to Arch Street, and terminate at White Street. In addition, the project will line fifteen sanitary sewer manholes to aid in limiting stormwater infiltration into the sanitary sewer system.  This project includes the remaining footage from the unfinished first phase of the High Level Trunkline Sanitary Sewer Rehabilitation Project. The construction of the project is scheduled for January through April 2023.

 

Lining is a trenchless technology which enables the pipe to be repaired without disturbing the surface above, although in this instance some disturbance may need to occur in order to install temporary bypass pipes to convey the sewer flow while the mains are lined. The lining of these sanitary sewers is critical to extending the service life of these pipes.

 

Engineering staff supervised the creation of plans and contract documents and bid the project through the City’s Procurement Unit. On October 20, 2022 two proposals were received for this work; however, one proposal was deemed not responsive due to the lack of a bid bond. A selection committee comprised of Public Services staff reviewed the remaining proposal from Insituform Technologies USA, LLC based on the criteria provided in ORD-21-41, adopted by Council on January 3, 2022:

After reviewing and scoring the proposal, staff recommends the project be awarded to Insituform Technologies USA, LLC.

 

Insituform Technologies USA, LLC. complies with the City’s Non-Discrimination and Living Wage ordinances.

 

Budget/Fiscal Impact:  The City of Ann Arbor Capital Improvements Plan (CIP) includes the High Level Trunkline Sanitary Sewer Rehabilitation Ph. 2 (UT-SN-22-11). The total estimated project cost is approximately $5,000,000.00. The project is planned to be funded by the Developer Offset Mitigation Fund. In the event there is not sufficient funding within the Developer Offset Mitigation Fund, the balance of the project would be paid for via the approved Sewage Disposal System Fund Capital Budget, where sufficient funding is available.

Whereas, The City of Ann Arbor Capital Improvements Plan (CIP) includes the High Level Trunkline Sanitary Sewer Rehabilitation Phase 2 Project (UT-SN-22-11);

 

Whereas, It is desirable to extend the service life of the existing sanitary sewer infrastructure through lining technology;

 

Whereas, The City of Ann Arbor received one responsive proposal for this work on October 20, 2022 from the Insituform Technologies USA, LLC, and after review, staff recommends award of the construction contract to that firm; and

 

Whereas, It is now necessary to enter into a contract with Insituform Technologies USA, LLC for the performance of this work.

 

RESOLVED, That City Council approves a construction contract with Insituform Technologies USA, LLC in the amount of $4,242,055.60 for the construction of the High Level Trunkline Sanitary Sewer Rehabilitation Phase 2 Project (RFP 22-70);

 

RESOLVED, That a contract contingency amount of $420,000.00 be established within the project budget and that the City Administrator be authorized to approve construction change orders not to exceed that amount, in order to satisfactorily complete this project;

 

RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said contract after approval as to form by the City Attorney, and approval as to substance by the City Administrator;

 

RESOLVED, That the City makes the following declaration for the purposes of complying with the reimbursement rules of Treasury Regulations 1.150-2 pursuant to the Internal Revenue Code of 1986, as amended, that the City reasonably expects to reimburse itself for expenditures for the costs of the Project with proceeds of Bonds; and

 

RESOLVED, That the City Administrator be authorized to take necessary administrative actions to implement this resolution, including issuing temporary and permanent Traffic Control Orders and night work authorizations as required for the construction of the project.
