This memorandum and resolution requests approval of a Professional Services Agreement for the Barton and Superior Hydroelectric Dams FERC Ninth Part 12D Inspections and Other Related Engineering Services with Geosyntec Consultants of Michigan, Inc., in an amount not to exceed $ 100,000.00, and to Appropriate $75,000.00 from the General Fund Balance.
The Barton and Superior Dams are the two Hydroelectric Generating Dams operated by the City and regulated by the Federal Energy Regulatory Commission (FERC). FERC requires the City to utilize a FERC-approved Independent Dam Consultant to complete Part 12D Inspections and Report every five years, in accordance with FERC (18 CFR Part 12, Subpart D) requirements. The last Part 12 Inspection and Safety Report was completed in 2018.
In July 2022, the City of Ann Arbor (City) issued a request for proposals for professional engineering services for the Barton and Superior Hydroelectric Dams as required by FERC. Proposals were received from two firms, Barr Engineering Co. and Geosyntec Consultants of Michigan, Inc The scope of this project includes inspections for both Barton and Superior Dams, as required under the Code of Federal Regulations (CFR) Title 18, Part 12, subpart D (Part 12D). FERC’s Engineering Guidelines (Chapter 16) for the Part 12D inspections were updated in 2022. The FERC Ninth Part 12D inspections will be Periodic Inspections as per FERC’s updated Engineering Guidelines. In summary, the scope of work will include the following: FERC Part 12D Periodic Inspections, including all preparation, correspondence, field work, and reporting; and downstream bathymetric survey at both dams.
The City received two (2) proposals for this work from the following firms: Barr Engineering Co and Geosyntec Consultants of Michigan, Inc. Barr Engineering was disqualified due to a conflict of interest. Geosyntec’s proposal was reviewed and it has been determined that they possess the qualifications necessary to perform the subject effort. It is therefore requested that City Council approve the recommended Professional Services Agreement with Geosyntec Consultants of Michigan, Inc. to perform the necessary professional engineering services as required by FERC for the Barton and Superior Dams.
Geosyntec Consultants of Michigan, Inc. complies with the Conflict of Interest, Living Wage and Non-discrimination ordinances.
Budget/Fiscal Impact: Funding is available in the FY23 Water Supply System Operation and Maintenance Budget. An Appropriation from the General Fund Balance in the amount of $75,000.00 is necessary to fund the General Fund portion of the work, funds are available in the General Fund Balance. A request to make the funding multi-year will allow funds not used in FY23 to be used in future fiscal years to complete the contract.

Whereas, Of the two (2) proposals received, Geosyntec Consultants of Michigan, Inc. was approved based on their professional qualifications, past experience, work plan, and fee proposal;
Whereas, Funding is available in the approved FY23 Water Supply System Fund Operating and Maintenance Budget and General Fund Balance; and
Whereas, Geosyntec Consultants of Michigan, Inc. complies with the City’s Conflict of Interest, Living Wage and Non-discrimination ordinances;
RESOLVED, That City Council approve a Professional Services Agreement with Geosyntec Consultants of Michigan, Inc. in the amount of $ 100,000.00 for completion of the Hydroelectric Dams FERC Part 12 Inspection and Report;
RESOLVED, That a contingency in the amount of $10,000.00 is approved to finance change orders to the professional services agreement with Geosyntec Consultants of Michigan, Inc. to be approved by the City Administrator;
RESOLVED, That $75,000.00 be appropriated from the General Fund Balance, thereby, increasing the revenue and expenditure budget within the General Fund for FY23;
RESOLVED, That the funds be available for the life of the project without regard to fiscal year until the Professional Service Agreement ends;
RESOLVED, That the Mayor and City Clerk are authorized and directed to execute the agreement after approval as to form by the City Attorney and approval as to substance by the City Administrator; and
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
