Resolution to Revise Chapter 40 - Rights of Way, Street Trees, Vegetation Management

Whereas, the existing version of Chapter 40, Section 3 results in excessive work for staff and tension in the community;
Whereas, Clear, concise language, with supporting documentation, would reduce staff effort and increase community adherence;
Whereas, Consistent, proactive enforcement, especially of sight distance violations and vegetation impeding travel on sidewalks and bike lanes would improve nonmotorized transportation safety;
Whereas, community members and staff are to be commended for their considerable effort to improving Chapter 40, Section 3;
Whereas, there is general agreement that this is a very complicated, multifaceted resolution; and
Whereas, the Environmental Commission passed a resolution in support of revisions to Chapter 40, section 3, in May 2022, and staff is continuing to refine those revisions;
RESOLVED, That the revisions to Chapter 40, Section 3 be presented to Council for consideration not later than the first meeting in November.
