Resolution to Approve Amendment to Midtown Ann Arbor Development Agreement to Modify Sequence of Construction 

Memorandum

The developer of Midtown has requested modifications to the construction sequence and to add utility phases, which city staff supports. This allows for building permits to be issued in phases while infrastructure is being completed.  Additionally, the City and developer seek to clarify the timing of the water pressure booster station be completed before issuance of any certificate of occupancy.  These changes necessitate amendment to the Midtown Ann Arbor Development Agreement.

Whereas, Midtown Ann Arbor LLC has requested that P-1, P-4 and P-6 of the Development Agreement be amended to modify the required construction sequence;     

 

RESOLVED, That City Council approve the First Amendment to the Midtown Ann Arbor Condominium Development Agreement;

 

RESOLVED, The Mayor and City Clerk be authorized and directed to sign the First Amendment to the Midtown Ann Arbor Condominium Development Agreement after approval as to substance by the City Administrator and approval as to form by the City Attorney; and

 

RESOLVED, That the City Administrator be authorized to take all necessary administrative actions to implement this resolution.
