Resolution to Approve the Board of Insurance Administration’s Recommendation to Approve a Workers Compensation Settlement Not to Exceed $30,000

Memorandum

This resolution requests the City Council’s approval of a workers compensation settlement for Cicy Jacob not to exceed $30,000 as recommended by the Board of Insurance Administration at its meeting on June 23, 2022.  This amount is in line with recommendations from our outside workers compensation attorney, and is part of a larger settlement agreement where the employee has agreed not to return to employment which will alleviate operational concerns in the Plant among other benefits to the City.

Body

Whereas, City Council must approve the Board of Insurance Administration’s recommendations to approve claims in excess of $10,000.00; and

 

Whereas, On June 23, 2022 the Board of Insurance Administration recommended approval of a settlement of a workers compensation claim brought by Cicy Jacob not to exceed $30,000 subject to a worker’s compensation redemption hearing and Magistrate approval of the settlement;

 

RESOLVED, That City Council approve the Board of Insurance Administration’s June 23, 2022 recommendation to approve a settlement of a workers compensation claim brought by Cicy Jacob not to exceed $30,000 subject to a worker’s compensation redemption hearing and Magistrate approval of the settlement;

 

RESOLVED, That City Council authorize payment of the settlement from the Risk Fund; and

 

RESOLVED, That the City Administrator and City Attorney be authorized to take the necessary administrative actions to implement this resolution including execution of any related documents.
