Resolution to Approve an Agreement Granting a Private Sanitary Sewer Lead Easement at 406 Maple Ridge (8 Votes Required)
Memorandum
This approves a grant of easement from the City to Orlando A. Crump and Stephanie Rosales, who are the owners of 500 Maple Ridge.
The City owns 406 Maple Ridge, a vacant lot which is maintained by Public Works and which contains City sanitary sewer trunk lines. In the process of decommissioning a redundant sewer line, the City needed to relocate 500 Maple Ridge’s private sanitary sewer lead. A large tree prevented the private lead from being placed entirely on 500 Maple Ridge, so a portion of the private lead was constructed on the City parcel at 406 Maple Ridge. A limited easement is now needed to allow the private lead serving 500 Maple Ridge to cross City property.
The easement has been reviewed and approved by all required City service areas and is being granted for no consideration. City staff recommends approval of the grant of easement.

Whereas, Orlando A. Crump and Stephanie Rosales are the owners of the property commonly known as 500 Maple Ridge Street, which is adjacent to City property at 406 Maple Ridge Street;
Whereas, The City has relocated a private sanitary sewer lead serving 500 Maple Ridge within the City property at 406 Maple Ridge and an easement is necessary to allow continued use of the sewer lead by 500 Maple Ridge;
Whereas, The owners of 500 Maple Ridge have agreed to the terms of an easement agreement;
RESOLVED, That the City of Ann Arbor hereby approves an easement agreement for a private sanitary sewer lead across 406 Maple Ridge Street, described as follows:
Commencing at the Northwest corner of Lot 24 of Assessor’s Plat No. 10 as recorded in Liber 8 of Plats, Page 19, Washtenaw County Records; thence South 6 feet to the point of beginning; thence East 40 feet along the North line of said property; thence South 69 degrees 26 minutes 38 seconds West 42.72 feet; thence North 15 feet along the Easterly right of way line of Maple Ridge Street to the point of beginning;
RESOLVED, That the Mayor and City Clerk are authorized to execute the easement agreement after approval by the City Administrator and City Attorney; and
RESOLVED, That the City Administrator and City Attorney are authorized to take all appropriate steps to effect this resolution.
